NRC Letter from Mr. Stello to Mr. Spence dated April 27, 1989 Gentlemen:

.n response to the referenced letter, TV Electric has undertaken a comprehensive review of the agreements entered into for settlement of disputes with employees or former employees.

In addition, we have requested a similar review by current contractors and major contractors used in the past for settlements with restrictive clauses. The request sent to such contractors was as follows-Consistent with the NRC's directive set forth in the first full paragraph on page 2 [of the Stello Iecter], please immediately determine whether you have entered into any settlement agreements, arising out of CPSES activities, with any of your present or former employees that contain any language which might arguably be construed as limiting in any way the providing of information to the NRC.

If any such agreements are found to exist, please immediately notify the employee involved that any such

" restriction should be disregarded, that he or she may freely come to the NRC at any time without any fear of any form of retribution, and that such a restriction will not be enforced." Please also provide TV Electric with a copy of all such notification letters.

If no such settlement agreements exist and no notification letters are therefore necessary, please confirm these facts by return correspondence to TU Electric.

The status of the contractor response is as follows:

.TXX-89525 July 31.,1989 Page 2 of 2 The NRC is already aware of the settlement agreement between Mr.' Joseph Macktal.and Brown and Root and the settlement involving Mr. L. Mario Polizzi and Gibbs and Hill. These agreements were fully discussed in connection with the Senate Nuclear. Regulation Subcommittee investigation.

Notification letters have been sent to both Mr. Macktal and Mr. Polizzi:by their former employers.

The result of this additional extensive review by TV Electric and its current and major contractors is that there are no restrictive covenants, as described by Mr. Stello, identified by this additional review.

Should any such agreements become known.from any past, present, or future contractors we will notify the NRC as requested in the referenced letter.
