Dear Mr. Friedman:
This is in further. response to 'your letter dated February 9,1989, in which you. appealed my response' dated January 27,1989. - Ny response denied 48 -
documents which were subject to your Freedom'of Information Act request filed with the Department of Justice.
The letter from Mr. Hugh L. Thompson, Jr. to you dated May 16, 1989 released 35 documents in whole or in part and stated that 13 documents had been referred to the Sacramento Muncipal Utility District (SMUD) for review to help NRC determine if they contained. confidential business (proprietary).information'.
SMUD has notified NRC that SMUD has no objection to the release of the documents.
Therefore, the 13 documents listed on the enclosed Appendix B are enclosed and are being.made publicly available.
This completes action'on your appeal.
