PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Comission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Fifty Thousand Dollars ($50,000) will be issued on or about June 2,1989 to GPU Nuclear Corporation. This action is based on a violation of the equipment qualification requirements of 10 CFR 50.49.
In accordance with the " Modified Enforcement Policy Relating to 10 CFR 50.49," contained in Generic Letter 88-07, the violation has been categorized as a Category C violation. The mitigation and escalation factors of the modified enforcement policy were considered and because of the licensee's corrective actions and best efforts the minimum civil penalty set forth in the policy is proposed. The staff was informed of the Comission's approval of this action on June 1, 1989.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice June 2, 1989 Telephone Notification of Licensee June 2, 1989 The State of New Jersey will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
