PROPOSED IMPOSITION OF CIVIL PENALTY - $87,500 This is to inform the Commission that a Notice of Violation and Praposed Imposition of Civil Penalty in the amount of $87,500 will be issued on or about September 22, 1989 to Tennessee Valley Authority. This action is based on three examples of failure to implement or adhere to safety review program requirements.

Two of the violations involved changes to the RHR and BIT alignments that resulted l

in the plant being operated in an unanalyzed condition. The third violation concerned.the failure to perform a required safety evaluation before changing the location of the intermediate range flux monitor, which effectively changed its setpoint. The civil penalty was escalated a total of 75%; 25% for multiple examples of operating the plant in an unanalyzed condition, and 50% for the prior notice of the RHR lineup issue and the licensee's poor past performance in the area of safety reviews.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Notice September 22, 1989 Telephone Notification of Licensee September 22, 1989 The State of Tennessee will be notified.,

The licensee has thirty days from the date of the Notice in which to respond.

l Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
