EVALUATION OF RULEMAKING PETITION AND EXEMPTION REQUESTS

Dear Mr. Judd:

This letter relates to your petition dated October 21,1992, which requested a rulemaking to include a categorical exemption from the special nuclear material (SNM) mass limits in 10 CFR Part 150 for persons generating or disposing of low specific activity wasa containing SNM not capable of forming a critical reaction. This letter also addresses your July 15,1997, and August 11,1997, letters to Chairman Jackson which requested that the rulemaking be expedited ard that an exemption from the 10 CFR Part 70 licensing requirements be granted.

The staff has consulted with the Commission regarding your petition. The Commission has directed the staff to focus its limited resources on review of your Part 70 license application.

Therefore, rather than take further action on your 1992 petition request at this time, the staff intends to focus on review and final disposition of your license application, which we expect to l receive shortly.

Prior to responding to your requests, the staff prepared a Commis n Paper (SECY-98-010) that addressed several policy issues related to your petition requ st and disposal of SNM. In the April 27,1998, Staff Requirements Memorandum that resp ded to this Commission Paper, the Commission directed NRC staff to focus its limited resour es on review of your Part 70 license application. Therefore, we intend to take no further ction on your 1992 petition request at this time.
