Dear Licensing Board Members:

On September 7, 1989, Thomas J. Saporito, Jr., on behalf of " Nuclear Energy Accountability Project" (NEAP), filed a document entitled " Request for Contention Reconsideration."

This document appears to be requesting the Licensing Board to reconsider its Memorandum and Order (June 8, 1989), which admitted part of Contentions 2 and 3.

For several reasons, the Licensing Board should not i

give any consideration to this request.

First, NEAP and Mr.

Saporito are not parties to this proceeding and therefore do not have any standing or right to file a request for reconsideration.

See 10 CFR S 2.751a(d) and 10 CFR S 2.771(a); Texas Utilities Electric Co. (Comanche Peak Steam Electric Station, Units 1 and 2), CLI-89-06, 29 NRC 348, 354 (1989).

Second, the request is untimely without good cause and therefore should be dismissed.
