Gentlemen:

This refers to the' inspection conducted by Mr. P. W. Michaud of this office

during the period June 23-27, 1989, of activities authorized by NRC Operating

License DPR-34 for Fort St. Vrain Nuclear Generating Station, and to the

discussion of our findings with Mr. A. C. Crawford and other members of your

staff at the conclusion.of.the inspection.

The area examined during this inspection was a followup on the circumstances

and events associated with the operation of Fort St. Vrain above the authorized

caximum power level of,82 percent of. full power. The maximum power level was

exceeded by. up to 1.6 percent for approximately 4 hours4.62963e-5 days <br />0.00111 hours <br />6.613757e-6 weeks <br />1.522e-6 months <br />. Within this area, the

inspection consisted of, selective examination of procedures and records,

interviews with personnel,' and observations by the NRC inspector. The

inspection findings are, documented ;in the enclosed inspection report.

During this inspection, it was found that certain of your activities were

apparently conducted in violation of NRC requirements. Because the NRC wants to

encourage and support licensee initiative for self-identification and

correction of problems, a notice of violation would not normally be issued in

accordance with the NRC Enforcement. Policy, Part 2, Title 10, Appendix C, for a

violatio_n that was self-identified, fits Severity Level IV or V, was. reported,

and corrective actions initiated. However, the failure to provide adequate

administrative controls to ensure that safety-related changes made to the plant

by the reactor support group, including computer software change.:. had been

properly incorporated into plant procedures is viewed by the NRC as having the

potential for serious safety consequences. Therefore, you are being required

to respond to the violation,'in writing, in accordance with the provisions of

. Section 2.201'of the NRC's " Rules of Practice," Part 2, Title 10, Code of

Federal Regulations.

In particular, your response should address corrective

actions to prevsint recurrence not only in the case of this specific violation

but also in your corrective actions to assure that safety related changes

introduced by other parts of your organization are properly incorporated into

your plant procedures.

The actions of the shift supervisor in identifying the improper input to the

secondsry heat balance and the prompt corrective actions initiated by plant

managaent are considered by the NRC to be worthy of recognition.

The response directed by this letter and the accompanying Notice is not subject

to the c!carance procedures of the Office of Managerrent and Budget as required

by the Pcperwork Reduction Act of 1980, "96-511.
