l APPENDIX A NOTICE OF VIOLATION Gulf States Utilities Company Docket:
50-458 River Bend Station Operating License: HPF-47 During an NRC inspection conducted on June 5-9 and 19-23, 1989, a violation of NRC requirements was identified. The violation involved the failure of the Facility Review Committee (FRC) and the Nuclear Review Board (NRB) to review safety questions associated with modifications.
In accordance with the
" General Statement of Policy and Procedure for NRC Enforcement Actions " 10 CFR Part 2, Appendix C (1988), the violation is listed below:
Failure to Review Safety Questions Associated With Modification Technical Specifications (TS) Section 6 establishes the requirements for the FRC and NRB and the requirements for these groups to review various activities. Section 6.5.1.6 requires FRC to be responsible for review of all modifications to structures, components, systems, or equipment that affect nuclear safety. Section 6.5.3.7 requires NRB to be responsible for the review of safety evaluations for changes to equipment or systems completed under the provision of 10 CFR 50.59 to verify that such action did not constitute an unreviewed safety question.
Contrary to the above, the FRC and NRB had not reviewed the activities required by TS.
FRC reviewed only 12 modification requests (MRs) of a sample of 19 facility changes described in the 1987-1988 annual 10 CFR 50.59 report. NRB reviewed only 17 safety evaluations associated with the same sample of changes identified above.
This is a Severity Level IV violation.

Pursuant to the provisions of 10 C.R 2.201, Gulf States Utilities Company is hereby required to submit to this office, within 30 days of the date of the letter transmitting this Notice, a written statement or explanation in reply, including for each violation:
(1) the reason for the violation if admitted, I
(2) the corrective steps which have been taken and the results achieved, (3)thecorrectivestepswhichwillbetakentoavoidfurtherviolations,and (4) the date when full u mpliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
