Dear Ms. Shillinglaw:

I am responding to your letter dated January 29,1998, addressed to Mr. Richard Savio of this office. In your letter, you requested information about (1) the current status of proposed changes to 10 CFR Part 72 related to dry cask storage and how will these changes be implemented, (2) who pays for the regulatory oversight and inspection of dry storage casks, and (3) which dry storage casks and multi-use casks have been certified and what casks are under review.

In response to your question regarding the current status of rulemaking, the Nuclear Regulatory Commission (NRC) staff has proposed several changes to 10 CFR Part 72 related to the storage of spent fuel in dry storage casks. The proposed rule entitled, " Miscellaneous Changes j to 10 CFR Part 72, Licensing Requirements for the Independent Storage of Spent Nuclear Fuel i and High-Level Radioactive Waste,"is being considered for publication. If the Commission  !

approves the proposed rule, it will be published in the Federal Register, and comments will be l requested from the public. The rulemaking plan entitled, " Elimination of 30-Day Hold in Loading l

Spent Fuel After Preoperational Testing of Independent Spent Fuel Storage or Monitored l Retrievable Storage Installations," has been approved. The staff is proceeding with the writing i of the proposed rule and will subsequently seek Commission approval for publication in the i FederalRegister, i The proposed rule entitled, " Expand Applicability of Part 72 to Holders of, and Applicants for, Certificates of Compliance and Their ContraGors and Subcontractors," is in development. The i rulemaking plan entitled, " interim Storage for Greater than Class C Waste, Changes to 10 CFR Part 72," is under review. In addition, the staff is evaluating two issues prior to development of a rulemaking plan; your petition (PRM-72-3), and a 10 CFR Part 40 change related to the use of ,

depleted uranium as shielding in storage casks. For future reference, the status of rulemakings ,

is published in NUREG-g36, *NRC Regulatory Agenda Semi-Annual Report," and it is available l l in the NRC Public Document Room. 1 L l During the development of the proposed rules, the staff also determines how the new rulee will  ;

be implemented and enforced. Since the proposed actions have not been approved by the Commission, it would be premature to address implementation and enforcement at this time. >

The current NRC enforement policy is stated in NUREG-1600, " General Statement of Policy and i Procedures for NRC Enforcement Actions."

in regard to your question on who pays for the inspection and oversight of activities related to dry cask storage,10 CFR Part 170 addresses the fees for applicants and license holders. The current requirement is that the applicant for, or a holder of, specific approval of a spent fuel cask j is responsible for cost of inspection performed by the NRC staff.
