' Nebraska Public Power District Docket: 50-298 Cooper Nuclear Station- Operating License:, DPR-46 Based on'the results of an NRC inspection conducted on July 31 through August 4, 1989, a deviation from your comitment to the NRC was identified. The.

deviation consisted of a failure to implement the approved water suppression system' and notify the NRC 'of the changed comitment. In accordance with the

" General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2 Appendix C (1989)-(Enforcement Policy), the deviaticn is listed below:

In letters dated June 28, 1982, and March 18, 1983, the licensee comitted to provide a fully automatic water suppression system in the service water intake structure. This comitment was accepted by the NRC in the Safety Evaluation Report dated September 21, 1983.

Contrary to the above, during .this inspection from July 31 through August 4, 1989, the inspector noted that the licensee had changed the commitment by providing a Halon system instead of a water suppression system in the service water intake structure and had failed to inform the NRC of this change to the comitment. Nebraska Public Power District is hereby requested to submit a written statement or explanation to this Office within 30 days of the date of the letter transmitting this Notice. This reply, should include for each deviation: (1) the reason for the deviation if admitted (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further deviations, and.(4) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
