DENIAL OF REQUEST FOR WITHHOLDING FROM PUBLIC DISCLOSURE In a letter dated May 1, 1989, the Northeast Nuclear Energy Company (NNECO)

. submitted a letter providing details of a recently completed assembly repair program et Hillstone Nuclear Power Station, Unit No.1.

That letter and the attached affidavit requested that the entire submittal be withheld from public disclosure pursuant to 10 CFR 2.790.

Your reasons for requesting our withholding of this information were that the information is proprietary to General Electric and contains trade secrett.

i He have reviewed your submittal and all of the supporting information in accordance with the requirements of 10 CFR 2.790 and have concluded that you have not provided sufficient justification for us to determine that the information sought to be withheld f' rom public disclosure contains trade secrets or proprietary information.'*0ur review could not identify what infonnation, if any, in your tubmittel could be classified as trade secrets or proprietary. Accordingly, we have concluded that the information sought to be withheld from public disclosure does not meet tLa requirements of 10 CFP 2.790.

In addition, our review has led us to the conclusion that the right of the public to be fully apprised as to the basis for the acceptability of your fuel assembly repair program outweighs the demonstrated concern for the protection of any competitive position. Therefore, your reauest to withhold your May 1, 1989, submittal from public disclosure is denied.

Within 30 days from the receipt of this letter, your May 1,1989 submittal on the fuel assembly repair program will be placed in the Public Document Rooms.

If, within thirty (30) dcys of the receipt of this letter, you request withdrawal of this document in accordance with 10 CFR 2.790 (c), your request will be considered in light of the e.pplicable statutes and regulations and a determination made whether the document will be withheld from public disclosure and returned to you.

If the document is returned to you, we request that you submit another versior, of the document that clearly indicates OFoi l
