Consent to Confirmatory Order Modifying License No. DPR-16, Oyster Creek Nuclear Generating Station NRC letter to GPU Nuclear dated April 27,1998 requested GPU Nuclear consent to incorporate the OCNGS Thermo-Lag fire barrier corrective action completion schedule commitment of Refueling Outage 18 with overall work package closeout by December 31, 2000 into a Confirmatory Order Modifying License. GPU Nuclear understands that the confirmatory order j
will be substantially the same as the order issued to WPPSS on March 25,1998. GPU Nuclear R
has agreed to waive its hearing rights based on this understanding, but is not waiving any right to a hearing with respect to any terms or conditions that are not disclosed in NRC's letter to GPU Nuclear dated April 27, 1998, or with respect to any future request' for an extension or modification based on a showing of good cause.
Accordingly, GPU Nuclear is transmitting the enclosed signed agreement as proposed in the above referenced NRC letter. If additional information is required, please contact Mr. David J.

I, Michael B. Roche, 'Vice President and Director, GPU Nuclear, Oyster Creek Nuclear
' Generating Station, hereby agree on behalf of GPU Nuclear that GPU Nuclear will comply with the following commitment:
GPU Nuclear shall complete final implementation of Thermo-Lag 330-1 fire barrier corrective actions at Oyster Creek Nuclear Generating Station described in the GPU Nuclear submittal to the NRC dated October 1,' 1997. The scheduled completion date for all corrective actions is Refueling Outage 18. Overall work package closeout will be completed by December 31,2000.
GPU Nuclear also agrees to incorporating this commitment into a Confirmatory Order Modifying License (Order) that will be effective' immediately upon issuance. I recognize that by signing below, GPU Nuclear consents to the issuance of an immediately effective Order incorporating the.
above commitment and, by doing so, pursuant to 10 CFR 2.202(a)(3), GPU Nuclear will not have a right to request a hearing on all or any part of this Order.
