This is in response to your letter dated June 19, 1989, requesting an exemption under 10 CFR 171.11, from payment of the annual license fee for the Shoreham Nuclear Power Station based on the LILC0/New York State Settlement Agreement. Your letter points out that one of the provisions of the Agreement is that LILC0 will not operate the Shoreham plant and therefore, the imposition of the 10 CFR 171 fee requirements poses an undue financial burden on the company and its ratepayers. LILC0 further states that the reasons for granting previous exemption requests in FY 1987 and FY 1988 from the annual fee remain the same.
The staff has completed its review of your June 19, 1989 exemption request and finds that the circumstances and conditions under which the previous exemptions were granted are significantly different from your current request. On April 21, 1989, LILCO received a full power operating license from the NRC to operate the Shoreham reactor. The i
staff views LILCO's current non-operating restriction as self-imposed and for the convenience of LILCO. There is currently no Federal restriction preventing full power operation of Shoreham.
In addition, the fee requirements of 10 CFR 171 are applicable for reactors that possess full power operating licenses. Any economic burdens associated with the operation of the Shoreham reactor are the result of LILCO's own decision.
Based on the information provided, LILC0 has failed to demonstrate under the provisions of 10 CFR 171.11 an adequate basis to support the exemption request. Therefore, your request for exemption from the annual fee provisions of 10 CFR 171 is denied.
