Dear fir. Floyd:
I have received your letter dated August 11, 1989, in which you transmit your appeal of a staff position regarding the use of Rosemou'nt transmitter trip units. Your appeal addresses th issue of the degree of diversity required when implementing hardware on a coiling water reactor (BWR) to comply with the requirements of the ATWS Rule (10 CFR 50.62).
An initial reading of your appeal indicates that there is new information included in your appeal. Accordingly, I have directed the staff.to perform a thorough review of your appeal and provide their recommendation to me.
In this regard, I would like you to substantively expand on the statements in your appeal that:
.1.
There is an unmeasured but significant risk of increasing maintenance-related-common-mode failures.
2.
Non-standard trip units require additional, similar spare parts, hence, the probability of installing incorrect parts increases. When diverse components are similar or identical in appearance, the probability of following the wrong calibration and maintenance procedure increases.
These drawbacks can lead to increased common-cause failures.
3.
Insufficient production time will exist to develop a closed feedback loop of quality improvements driven by field-proven performance.

I have received your letter dated August 11, 1989, infich you transmit your

third appeal of a staff position regarding the use of Rosemount transmitter trip units. Your appeal addresses the issue of the' degree of diversity required when implementing hardware on a boilin 4ater reactor (BWR) to comply with the requirements of the ATWS Rule (10 CF 0.62).
My initial reading of your appeal indicatp that there is new information included in your appeal. Accordingly, /have directed my staff to perform a thorough review of your appeal and pr ide their recommendation to me.
The main focus of the staff revie and say decision will be to ensure that the overall reliability of the sera unction has been improved through implementa-tion of the ATWS Rule and not graded as you suggest.
In particular, we must be assured that, after consi ring reasonable alternatives, replacing the Rosemont trip units will im ove the capability of the scram function with respect to the potential f r common mode failures of all trip units in both the reactor trip system and e alternate rod injection system.
In this regard, I would like you to substirntively expand on the statements in your appeal that:
