Enforcement Conference held at the Region I office in King of Prussia on March 21, 1989 to discuss the violation identified during are inspection conducted January 30, 1989 and licenree's failure to establish and maintain effective controls over generally licensed byproduct material.
Enforcement options available to the Commission were reviewed.

Conference Summary.

Malcolm R. Knapp, Director, DRSS explained that the recurrent nature of the incidence of lost nuclear gauges and the inability of past corrective actions to effectively stop these losses is of serious L
concern to NRC and that NRC could take a series of actions-including a possible Civil Penalty and an Order modifying the license in an effort to correct the problem.

Benjamin Thorp, Senior Vice President Engineering, James River Corporation characterized the company as one which is extremely concerned about safety. He stated that the apparent violation did not occur by intent. Mr. Thorp presented a commentary issued to all employees informing them of James River's policy on-business ethics, j

Daniel J. Holody, Enforcement Officer, asked James River representatives for an explanation as to why two nuclear gauges were successfully.
removed and properly stored and one was not, in the October 1988 incident at South Hadley, Massachusetts.

Alfred T. DiLascia, Vice President and Executive General Manager, James River Graphics Group, explained that a human error occurred in the October 1988 incident, in that the contractor, the A. J-Green Company, was not aware of the presence of a third gauge in the machine -
identified to the contractor. He further stated that the missing gauge was on the inventory and should have been identified to the contractor, John C. Cuthbertson, Director Environmental Field Services, described-e.
i James' River Corporation's action plan as a' result of the 1984 and 1986 loss gauge incidences.
Specifically, an inventory questionnaire was sent to each facility and returned after the 1984 and 1986 incidences.
A similar questionnaire was distributed in February 1989 in response to the latest incident.
Mr. Cuthbertson described a compliance manual which is being developed for each facility which will include procedures-designed to prevent gauge loss, f.
Robert K. Christopher, Enforcement Specialist, asked if the compliance manual being developed is the same as the one that was to be developed as corrective action to the 1986 source loss incident.
Mr. Cuthbertson explained that the content of the manual has been -
enhanced since 1986.

Mr. Thorp indicated that the company is focusing on situations which involve removal or overhaul of equipment containing nuclear gauges, since that is when loss of devices has occurred.
He stated that the company is re-writing their contracts to outside agencies-to prohibit such companies from removing nuclear gauges. Additionally James River is alerting their purchasing personnel to inform the designated Radiation Safety Officers at each site, of the purchase of each new nuclear gauge so that accountability and control can be maintained.

John R. White commented that NRC does not currently have assurance that the Corporation has developed a system to sufficiently control and thereby prevent the recurrent improper disposition or loss of nuclear gauges.
In response, Mr. DiLascia described the following corrections which have been made.
1.
The Monthly Safety Audit Checklist of safety equipment has now been revised to add an area for status of nuclear gauges.

A new Equipment Safety Checklist has been created which designates that nuclear gauges are to be checked.
3.
Nuclear Gauge identification labels were replaced and added to gauges as required.
4.
The radiation sign was removed from the empty gauge.

Mr. Cuthbertson described an audit that the Corporation performs on five to ten percent per year of their larger facilities at which time radioactive devices are checked.
A consulting firm also performs an audit on thirty to forty of the facilities per year with some check 1
i of radioactive sources.

Mr. Knapp expressed his concern that James River has so far provided very little in substantiative changes to prevent recurrence, k.
Mr. Christopher outlined the NRC's enforcement options as specified in 10 CFR 2, Appendix C.
