Assistant General Manager Nuclear Gentlemen:

In your June 21, 1989 letter to me, you reiterated your commitment.to develop a closure plan and:

i "to implement the [ Rancho Seco] closure plan in a safe and deliberate manner fully ce glying with the license'and ... with all applicable laws and regulations...."

. In your June 30,1989 .1kter transmitting the Rancho Seco ' Closure ' Plan, you stated that the. plan described how you would conduct your closure activities "in an orderly manner while continuing to comply with Technical-

-Specifications, regulations Land commitments." Finally, in an August 29, 3089

' meeting with'the NRC staff, you repeated-these commitments. Taken together,

your statements; suggested that you would dn more than the minimum of complying i with NRC requirements.

Notwithstanding these, commitments, a recent NRC inspection completed September.

1, 1989 determined that your. preparedness to respond to an emergency was

' degraded to the point where,you needed to' invoke unusual measures to restore your emergency response. capability to"an acceptable level. The report on this inspection is currently being, prepared, and we expect to consider' enforcement

. action 'in the near future. '

The _ apparent ~ violations, in brief, involve your failure (1) to assign individuals" qualified in accordance with your Emergency Plan Implementing Procedures to critical emergency response positions, (2) to remove individuals from the emergency response organization when their retraining was not completed -and (3) to conduct a required semi-annual health physics drill.

These: lapses appear to contraveneLthe mandatory NRC requirements in your license, 'and your commitment that you would do what is needed to assure safe Joperation of'the facility.

While you have remedied some of the identified problems,.your failure to comply with the minimum emergency preparedness requirements compels me to request your reassurance that you are complying with NRC requirements, including 10.CFR Part 50, Appendix E, and your commitments in other program areas. Accordingly, pursuant to 10 CFR 50.54(f), you are to provide to me within seven days of the date of this letter, your assessment of your compliance with these requirements and with the commitments in your letters ,
