SAFETY EVALUATION FOR COMPLIANCE WITH THE ATWS RULE - 10 CFR 50.62 (TAC N0. 65854) l The NRC staff has completed its review of your submittals concerning comp (liance with the ATWS Rule for Millstone Unit 3.

The enclosed Safety Evaluation SE) concludes that the AMSAC design proposed by Northeast Nuclear Energy Company for the Millstone Nuclear Power. Station, Unit 3, is acceptable and is in compliancewiththeATWSRule,10CFR50.62, paragraph (c)(1).

The issue of Technical Specifications for ATWS requirements remains an open I

issue as indicated in Item 14 of Section 3.0 of the enclosed SE. Until staff 4

review is completed regarding the use of technical specifications for ATWS

)

requirements, the licensee should continue with the scheduled installation and i

implementation (planned operation) of the ATWS design utilizing administrative 1y contrclied procedures.

This completes all staff at.tivities related to TAC No. 65854.
