DENIAL OF A!4Et4Dt'EllTS TO FACILITY OPEr ATING LICENSES AND OPPORTUNITY FOR A HEARING The U.S. Nuclear Regulatery Commission (the Commission) hes cenied

a request by the licensee for amendments to Facility Operating License Nos.

NPF-9 and NPF-17, issued to the Duke Power Conpany (the licenseee) for operation of the McGuire Nuclear Station (the facility) located in Mecklenburc Cour.ty, North Carolina. 3 The amendments, as prcposea by the licensee, would raodify McGuire Technical Specification 3/4.7.7, "Auxilicry Cuilding Ventilation Exhaust (VA) System" to allow one system to be inoperable for sever deys instead of the current ?4-hour time limit. The licensee's application for the erendments was dated September 16, 1985. Notice of consideration of issuance of these amendnents was published in the Federd Pegister on October 23, 1085 (50 FR 43023).

Although the Commission initially proposed a determination of "no significar.t hazards consideration" regarding the amendment request, upon additional cer-1 l

The licensee was nctified of the Comrrission's denial of this request by letter dated January 7, 1987. -

Dy Feb 12,1987, the licensee may demand a hearing with respect to the denial oescribed abcVe and any person whose interest nay be affected by the proceeding raay file a written petition for leave to intervene.
