Dear Mr. Kulesh:

I am responding to your letter of February 21, 1989, to Chairman Zech, which has been referred to me for reply. In your letter, you expressed concern about the adequacy of Long Island's electrical power supply for this summer and a need for expedited licensing of the Shoreham facility.

As you may know, the Shoreham plant has been the subject of much litigation before the NRC's Atomic Safety and Licensing Boards. Most recently this litigation has centered on evacuation plans for the facility. On September 23, 1989, the Licensing Board in the Shoreham proceeding issued its concluding Initial Decision on Emergency Planning. It'found, among other things, that the interveners (New York State, Suffolk County, and Southampton Township) were in default of Board orders and dismissed them from the proceeding. On March 3, 1989, the Commission dismissed the interveners from further partici-pation in the Shoreham proceedings because they willfully defied the Licensing Board's orders. A copy of this Commission Decision, CLI-89-02, is enclosed.

The Commission directed that the staff evaluate all of interveners' outstanding contentions. The staff's evaluation and recommendations concerning safety of facility operation will be presented in a public meeting to the Commission which will make the final decision on issuance of the full-power license for Shoreham.

It is the duty and obligation of the Commission d its staff to preserve the integrity of this licensing process. On March , 1989, the Commission dismissed the interveners, New York State, Suffoll/ County and Southampton Township from further participation in the Shoret)6m proceedings because they willfully defied the Licensing Board's orders, thereby causing great harm to the integrity of the Commission's adjudicatory process. A copy of this Commission Decision, CLI-89-02, is enclos .

The Conmission further direc ed that the staff evaluate all of the interveners' contentions thdt were left pending as a result of this decision.

Once the staff has completed this evaluation, made other necessary findings, and demonstrated to the Jommission's satisfaction that operation of the Shoreham facility woulcVnot adversely affect the' public's health and safety, then a full-power opepating license will be issued. Assuming favorable findings from the work that remains to be done, issuance of the full-power license for Shoreham could occur in time to meet the summer electrical loads.
