DENIAL OF PORTION OF APPLICATION FOR AMENDMENT TO FACILITY OPERATING LICENSE FLORIDA POWER CORPORATION, ET AL.4 DOCKET NO. 50-302 The United States Nuclear Regulatory Connission (the Commission) has denied

_l a portion of a request by Florida Power Corporation (the licensee) for an amend-ment to Facility Operating License No. DPR-72, issued to the licensee for opera-tion of the. Crystal. River Unit 3 Nuclear Generating Plant ~(the facility), located in Citrus County, Florida.

i The proposed amendment requested changes to Section 6, Administrative

' Controls, and requested modification of the audit frequencies for the Security, Emergency and Fire Protection plans to be consistent with 10 CFR 73.40(d).

Notice of Consideration of Issuance of this amendment was published in the FEDERAL REGISTER on February 24,1984(49FR7035)

The licensee's application for amendment was dated April 14, 1983, as modified December 13, 1983, July 25, 1984, January 24, 1986, October 16, 1986 and August 18, 1987.

I One of the requested changes to Section 6, Administrative Controls, involved the addition of a footnote to Figure 6.2-1, " Corporate Organization," and Figure 6.2-2, " Facility Organization," which would have stated that the organi-zations may be changed "without prior License Amendment provided that a revision to. Figure 6.2-1[andFigure6.2-2]isincludedwiththenextLicenseAmendment request." The staff determined that the proposed footnote was not acceptable, even though the staff does not disagree with its intent. The staff recognizes P

the addition of the foot. note as an attempt by the licer ;e to address the problem of burdensome administrative effort and delayh in wigementation of desired organizational changes. However, the proposed footnote would permit unilateral licensee changes to the Technical Specifications (TS) without prior NRC review l

and approval. This would violate the regulations. A more appropriate solution is presented in NRC Generic letter 88-06, which permits removal of the organiza-tion charts from the TS with appropriate changes to the administrative control i

requirements of the TS.

By letter dated April 27, 1989, the if censee comitted to proceed expedi-tiously to request an amendment removing the organization charts from the TS in accordance with Generic Letter 88-06.

The licensee was notified of the Comission's denial of this request by letter dated May 5, 1989.

By June 14, 1989

, the licensee may demand a hearing with respect to the denial described above and any person whose interest may be affected by this proceeding may file a written petition for l eave to intervene.

A request for leave to intervene must be filed with the Secretary of the Comission, U.S. Nuclear Regulatory Commission, Washington, D.C. 20555, Attention: Docketing and Services Branch, or may be delivered to the Comission's Public Document Room, 2120 L Street, N.W., Washington, D.C. by tre above date.
