A reactive safety inspection was corriucted by Mr. J. Furia of this office on
June 29, 1989, of a shipment of a SeaVan containing radioat.tive materials from
Jmerick Unit 1 to the Quadrex Recycle Center, Oak Ridge, Tennessee. 'Ihe
inspection consisted of selective examination of records, procedures and
intexviews with personnel by the inspector. 'Ihe firdings of the inspecti an were
discussed with Mr. L. Wr01s and other members of your staff at the conclusion of
the inspection on June ".9, 1989. 'Ihe details of the inspection are contained
<
in the attached inspection report.
Based on the results of this inspection, it appears that certain of your
activities were not conducted in full compliance with NRC requirements.
Specifically, on June 20, 1989, a Sed /an was shipped from Limerick Unit 1 to
Quadrex, where upon receipt on June 21, 1989, it was determined that the maximum
surface radiation level on the trailer used to transport the SeaVan was 250
milliroentgen per hour (mR/hr). This is in excess of the maximum allowable
radiation level of 200 mR/hr permitted under the U.S. Department of
Transportation regulations as set forth in 49 CFR 173.441(b)(2).
Of concern to the NRC is your lack of control in this area which resulted in
failure to properly package the material to ensure that external radiation
levels were maintained within regulatory limito.
Dased on the results of this inspection ard the discussion between Mr. M.
McCormick of your staff arn Dr. Ronald R. Bellamy of this office on July 7,
1989, we lave scheduled an Eru.kmment Conference in the Nuclear Regulatory
Commission, Region I Office, to discuss this matter with you. That conference
has been sabeduled for July 17, 1989 at 11:00 a.m.
'Ihe conference will provide
both of us the uppvrtunity to achieve a comman urderstarding of the facts
associated with the incident, and also provide you the opportunity to discuss
any ritigatirg circumstances for the incident and your plans for short-tcrm and
long-term evuuctive actions. 'Ihe need for and the nature of appropriate
enforcement actions for the apparent violation will be the subject of separate
correspondence at a later date.
