Dear Congressman Gephardt:

I am responding to ycur letter of July 13, 1989, in which you supported Missouri State Senator Jay Nixon's request !ar an informal adjudicatory proceeding on the planned expansion of operations at the Combustion Engineering plant in Hematite, Missouri.

Senator Nixon's request was forwarded-to the Chairman of the Atomic Safety and Licensing Board Panel, who,

.on July 24, 1989, appointed Administrative Judge Charles Bechhoefer as the ; residing officer for this matter under the Commission's rules for materials licensing pro-ceedings (10 C.F.R. Part 2, Subpart L).

Judge Bechhoefer will review the petition and will_ conduct the hearing if he determines the petition meets the requirements of Subpart L.

It is my understanding that Senator Nixon has also expressed an interest in having the Nuclear Regulatory Commission (NRC) staff participate in a public meeting to be held in the area of the plant.

The Commission agrees that a public meeting in the vicinity of the plant will provide a useful opportunity l

for interested citizens to express their views on the proposed license amendment.

Accordingly, the NRC staff, after con-

sulting with interested individuals and groups in Jefferson County, has arranged for a meeting to be held on August 24, t

1989, at 7:30 p.m.,

at Jefferson Junior College in Hillsboro, j

Missouri.

Representatives of the staff will attend the meeting.

I want to assure you that the NRC will carefully consider the views expressed by citizens living near the plant before acting on the proposed license amendment.
