UNITED STATES NUCLEAR REGULATORY COMMISSION n
{
WASHINGTON, D. C. 20555 August 16, 1989 CHAIRMAN I
The Honorable Norman H. Bangerter Governor of Utah Salt Lake City, Utah 84114
Dear Governor Bangerter:
I have received your letter of July 17, 1989, in which you propose an amendment to the existin Nuclear Regulatory Commission (NRC)g agreement between the and the State of Utah.
Under your proposal, Utah would assume regulatory authority over the land disposal of source material, byproduct material, and special nuclear material received from other persons.
This request does not cover special nuclear material in quantities sufficient to form a critical mass or byproduct material as defined in Section 11e(2) of the Atomic Energy Act of 1954, as amended.
The NRC staff is preparing an assessmenf of the proposed amendiaent and will publish these documents in the Federal Register for public comment.
A press release conceFning your proposal will be issued at that time.
After the expiration of the 30-day comment period, the Commission will consider the amendment and any public comments we have received.
We will promptly inform you of our decision.
We are pleased.with your continued interest in participating in the NRC's Agreement States Program and look forward to the continued excellent relationship we have enjoyed in the past.
Sincerely, w,A%.b Kenneth M. Carr h
