Dear Mr. Jager:
This refers to your letter dated October 11, 1988, pertaining to the use of. radioactive materials in lightning rods. In your letter, you requested infonnation regarding NRC policy on the use of radioactive materials in lightning rods and inquired if the NRC had ever performed risk assessments on these devices. Since your request does pertain to NRC policy, we have forwarded your letter to our headquarters program office for their assistance. We will notify you of the NRC policy as detennined by the program office as soon as that information becomes available. In an effort to evaluate the health and safety or regulatory aspects of these devices being distributed by a company in New York, we have been in contact with our Region I Agreement State Officer, the Heary Brothers Corporation, and the New York Department of Labor. Information which we currently have available is that Heary Brothers has distributed lightning rods containing tho rium-232. In discussions with the New York Department of Labor, we have been informed that the Heary Brothers Corporation is currently undergoing an inspection, and the issue of lightning rod distribution will be pursued during the. course of the inspection to determine such things as types of radioactive materials being used and under what provisions the material is authorized. If there is any significance to their findings, we will inform you as soon as that information is made available. Radioactive Lightning Rods A specific radiological concern has recently surfaced in Michigan which relates to the use of radium-226. In August, we became aware that lightning rods containing radium-226 were being installed on Michigan buildings. The lightning rods are distributed by Heary Brothers, Lightning Protection Company, Inc. of Springville, New York (a state of New York licensee). The radium sources are apparently manufactured in England and imported by the licensee for assembly into lightning protection systems. The licensee describes the device as a " Lightning Preventor". The device is available in several models containing up to 0.72 millicuries of radium-226 per device. The radium is equally distributed in nine separate foils attached in an array surrounding a central conducting rod. According to the licensee, the radium sources are used to produce, through alpha emissions, a volume of high density ionization near the lightning rod tip in order to attract the lightning bolt and safely dissipate the electrical energy to the carth. One of our obvious concerns relates to the company's choice of radium as the material to be used in the devices, instead of a less hazardous radionuclides. But perhaps a more obvious and fundamental question is: Why use radioactive material at all? Michigan is a non-Agreement state which requires registration of all NARM sources in the state with the Michigan Department of Public Health. The lightning rod installations were not registered. In
- addition, the licensee did not report its installation activities to the Department.
The licensee was not aware that the regulatory requirements applicable to NARM could vary from state to state. We have been in contact with both the licensee and the State of New York concerning these and other regulatory issues. Upon further investigation, we received several documents containing or referring to studies indicating that the use of radioactive materials for the purpose of altering the path of lightning discharges has no demonstrated advantage over conven-tional, non-radioactive lightning protection systems. On October 4, 1988, the Michigan Radiation Advisory Board, after reviewing the information
- received, adopted a resolution that concluded that the use of radium-226 in lightning protection systems is not justified in tiichigan due to the existence of safer alternatives.
The Department concurs with the determination of the Board and w wn .M,,
s b . will notify the licensee accordingly. As a result, the licensee will be expected to remove the radium bearing lightning rods from all Michigan locations. We have evidence of similar installations in several other states including California,
- Colorado, Connecticut, Florida, Georgia, Massachusetts, New Hampshire, New
- Jersey, New York, Oklahoma, Pennsylvania,
- Texas, Virginia, and Washington, D.C.
Based on discussions with the Texas Bureau of Radiation Control, we understand that the state of Texas shares our concerns and may take appropriate regulatory action in their state. Other manufacturers, distributors, or installers may have per-formed similar activities in the past with radium sources and/or sources containing americium-241. For example, we learned that V Underwriters Laboratories (UL), in July, 1958, refused to test a prototype radioactive lightning rod which reportedly contained radium-226 in sources manufactured by U.S. Radium Company. Incidentally, the test refusal by UL was partially based on a UL request for additional investigation of the radiation risks. The extent of distribution of radioactive lightning rods by vario s manufacturers is a matter that should be further investigated by all interested states, as well as the U.S. Nuclear Regulatory Commission. A copy of relevant information is being shared with the Region III office of NRC with a request that NRC investigate the use of americium-241 in lightning rods. In addition, information is also being shared with the Lightning Protection Institute (LPI), who has agreed to disseminate the information within the industry. The potential for older units surfacing in the antique market also exists.
