APPENDIX A C&D Charter Power Systems Incorporated Plymouth Meeting, Pennsylvania NOTICE OF VIOLATION As a result of the inspection conducted on May 8-11, 1989, and in accor-dance with Section 206 of the Energy Reorganization Act of 1974 and its implementing regulation 10 CFR Part 21, the following violation was identified and categorized in accordance with the NRC Enforcement Policy (10 CFR Part 2, Appendix C), 51 FR 30839 (August 29,1986):

Section 21.21 of 10 CFR Part 21, states, in part: "Each individual, cor-poration, partnership or other entity subject to the regulations in this part shall adopt appropriate procedures to: (1) provide for (i) evaluating deviations or (ii) informing the licensee or purchaser of the deviation-in order that the licensee or purchaser may cause the deviation to be evaluated unless the deviation has been corrected."

Contrary to the above, C&D Charter Power Systems (CPS), failed to notify all its customers of a deviation af ter Limerick Generating Station, Unit I notified C&D CPS in 1987 and 1989 that Battery Charger Model ARR130K300 was not able to meet required output current with the latest revision of replace-ment circuit boards. (89-01-01)

This is a Severity Level IV violation (Supplement VII).
