p NOTICE OF VIOLATION'

-Combustion Engineering, Inc. Docket No. 70-1100 l .

Windsor, Connecticut License No. SNM-1067 L

I As a result of the inspection conducted at the Nuclear Fuel Manufacturing and-Nuclear Laboratories on July 17-21, 1989, and in accordance with the NRC Enforcement Policy (10 CFR 2, Appendix C), the following violation was identified.

Condition No. 21 of License No. SNM-1067 requires: "The licensee shall maintain and execute the response measures of his-Radiological Contingency Plan submitted to the Commission on June 7, 1982. The licensee shall maintain implementing procedures for his Radiological Contingency Plan as necessary to implement the Plan."

Section 7,.3 of this Plan, entitled " Tests and Drills", states, in part:

" Semi-annual site emergency evacuation drills are conducted to test promptness of response, adequacy of procedures, emergency equipment, and the overall effectiveness of the emergency plan. At least one of the two drills given annually will be part of an overall exercise thht involves participation by off-site agencies to test as a minimum the communication'11nks and notification procedures."

Contrary. to the above, in 1988, the licensee failed to conduct a drill that was part of an overall exercise involving participation by off-site agencies.

This is a Severity Level IV violation. (SupplementIX).

Pursuant to the provisions of 10 CFR 2.201, Combustion Engineering is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
