PAYMENT OF CIVIL PENALTY PROPOSED BY NRC This will acknowledge receipt of your payment of $62,500 in your response dated March 27, 1989 to our Notice of Violation issued on March 2, 1989, concerning activities conducted at your V. C. Summer facility. We have evaluated your response and found that it meets the requirements of 10 CFR 2.201. We will examine the implementation of your corrective actions during future inspections.

In your response to violation 1(D), you stated that although a search might have been prudent, it was not required under the circumstances of this case and, therefore, there was no violation.. Event.3A of your Safeguards Contingency Plan requires you to investigate and assess the level of loss or degradation.

- As evidenced by your actions described in the event report (LER 88-S04), this included a determination of whether an unauthorized entry occurred as a result of this degradation.

Interviews of persons inside the area are not adequate to make this determination when these individuals have not been tasked with the responsibility of observing the hatch. When the person controlling access fails to do so, a search of the area is necessary to determine whether an unauthorized entry occurred.

Therefore, Violation I.D remains as cited. We have noted your coment'on the change of dates in Violations I.C and I.D and will revise our records to reflect it. We have concluded that your corrective actions, namely the Security Effectiveness Evaluation Program, appear adequate and no further response is expected in this matter.
