The Nuclear Regulatory Comission (the Comission) has found that:

The application for amendment filed by Detroit Edison Company (the licensee), dated May 17, 1985 as supplemented by letters dated July 23,'1986, September 15, 1986, September 25, 1987, September.15, 1988 and December 22, 1988 complies with the standards and require-ments of the Atomic Energy Act of 1954, as amended (the Act), and the Comission's regulations as set forth in 10 CFR Chapter I;-

B.

The facility will be maintained in conformity with the application, the provisions of the Act, and the regulations of the Comission; C.

There is reasonable assurance: (1)thattheactivitiesauthorizedby this possession-only license can be conducted without endangering the health and safety of the public,- and (ii) that such activities will be conducted in compliance with the Comission's regulations set forth in 10 CFR Chapter I; D.

The licensee is technically and financially qualified to engage in the activities authorized by this ainended license in accordance with the rules and regulations o'f the Comission; E.

The^1icensee has satisfied the applicable provisions of 10 CFR Part 140, " Financial Protection Requirements and Indemnity Agreements" of the Comission's regulations; F.

The issuance of this license will not be inimical to the common defense and security or to the health and safety of the public; G.

The issuance of this license is in accordance with 10 CFR Part 51 of the Comission's regulations and all applicable requirements have been satisfied; and j

H.

The possession and storage of byproduct material as authorized by this amended license will be in accordance with the Commission's regulations in 10 CFR Part 30, including 10 CFR Section 30.33;

Accordingly, Possession-Only License No. DPR-9 is hereby amended in its entirety to read as follows:

A.

This amended license applies to the Enrico Fermi Atomic Power Plant,

-Unit No.1 ( the facility) owned by The Detroit Edison Company. The facility is located at Lagoona Beach, Frenchtown Township, Monroe, Michigan and is described in the application for renewal dated May 17, 1985 as supplemented by letters dated July 23, 1986, September 15, 1986, September 25, 1987, September 15, 1988 and December 22, 1988.

B.

Subject to the conditions and requirements incorporated herein, the Commission hereby licenses The Detroit Edison Company:

(1) Pursuant to Section 104c of the Act and 10 CFR Part 50,

" Domestic Licensing of Production and Utilization Facilities" 1

to possess but not to operate the facility.

j (2) Pursuant to the Act and 10 CFR Part 30, " Rules of General Applicability to Domestic Licensing of Byproduct Material" l

to possess, but not to separate, such byproduct material as may have been produced by operation of the reactor.

C.

This license shall be deemed to contain and is :,ubject to the conditions I

specified in Part 20, Section 50.59 of Part 50, Section 30.34 of Part 30, of 10 CFR Chapter I, and is subject to all applicable provisions of the Act, and to the rules, regulations and orders of the Commission now or

hereafter in effect, and is subject to the additional condition specified below:

(1) The Technical Specifications contained in Appendix A as revised through Amendment No. 9 are hereby incorporated in j

this license. The licensee shall maintain the facility in

accordance with the Technical Specifications.

DEFINITIONS Physical narrier - Fences constructed of No. 11 AWG, or heaviet, 1.

Protected Area - An area encompassed by physical barriers and to which access is controlled.

(This area is consistent with 1

Custodian - The custodian is the individual responsible for directing the activities at the site, seeing that the activities are done in a safe manner and in compliance with the Technical specifications, and reporting these activities to the NBC.

Authorized Person - A person having written permission, which may take the form of composite lists of names, from the Custodian or Delegate to enter a Protected Area. Any irdividual escorted by i

1 such a person is also authorized.

5.

Writu order - As used herein the term " written order" shall mean a nonnal plant operating or maintenance order which has been personally approved and signed by the Custodian or Delegate.

Primary Systen - The primary system is defined as the reactor vessel and all connecting volumes. These include the three primary loops, the primary shield tank, the machinery dome, and the primary sodium service and secondary sodium systems out to welded fittings.

PUEL AfD REPAIR EDIIDDU l.

Access - tbrmal access to the Fuel and Repair Building shall be limited to the door at the southwest corner of the building. All other external access doors shall be locked from the inside or permanently closed unless they are needed for work being carried out. At least one door shall be operable from the inside.

DIAiDs - All drains are connected to sunps. The sump punps discharge to the liquid waste holdup system. The pumps may be disconnected or decctimissioned when no longer needed for disposing of radioactive waste.

WASTE DISPOSAL SURVRTTIArrp.9 Prior to cormencing discharge of any liquid effluent, monitoring facilities in the liquid waste disposal system shall be provided to ascertain the concentration of radioactivity. If a radiation instrument is out of service such that the effluent cannot properly be monitored, discharge of the effluent shall be discontinued.

During periods when radioactive effluents are being discharged, the discharge radiation monitor shall be checked for response ora:e a week with a source and shall be calibrated at least once every siy nonths or before each discharge batch.

Liauid Effluents - Radioactive waste discharges to offsite locations shall not exceed the limits given in 10CFR20, Appendix B, Table II, Column 2, on an instantaneous basis.

Records of periodic checks, inspections and/or calibrations performed to verify that surveillance requirements are being met.

Records of plant radiation and contamination surveys.

Records of CO cover gas usage, 2

Records of radioactivity in liquid wastes released to the environment.

Records of shipnents of radioactive materials.
