This is in regard to the contact you made with our Davis-Besse Senior Resident Inspector concerning our resolution of an issue with your requiring plant personnel to enter containment to perform maintenance work while the plant is at power. As discussed in a telephone call between Mr. W. Forney and other members of my staff and Mr. L. Storz of your staff, I am enclosing a copy of our allegation close out letter sent to an alleger who brought potential Davis-Besse safety concerns to the attention of the Occupational Safety and Health Administration (OSHA). OSHA in turn forwarded the containment-entry- j at-power concern to us for our review and disposition. We have intentionally deleted the alleger's name and address to protect his identity.

From our review of the alleged practice of performing work in containment with tha reactor at power, we did not identify any violation of NRC requirements.

.I However, as discussed with Mr. Storz, we do expect Davis-Besse management to take necessary precautions to evacuate the containment should a potentially severe transient occur. Also you must ensure that 10 CFR Part 20 limits are not exceeded and your ALARA program is considered.

Dear Sir:

On April 13, 1989, the Occupational Safety and Health Administration (OSHA) sent us a letter requesting that we review your complaint allegation concerning entry into containment at power and take the appropriate action (seeattachedletter). This letter is to document our telephone call to you l on April 28, 1989, at which time we provided to you our evaluation of the licensee's practices as stated in your allegation. Below is a sumary of

.your concern and our evaluation of the alleged licensee's practices.

You stated in your allegation that entry into containment at power is unsafe because a reactor coolant pressure transient could occur and possibly result in blowing reactor coolant into the containment building. You also stated that past plant management had deemed these areas to be unsafe and disallowed entry into these areas for routine maintenance whereas current management now believes all of these areas are safe to work in without any changes to plant design.

The NRC has reviewed the Davis-Besse practices as alleged and has determined

) they do not violate any procedures or NRC requirements. Furthermore, the NRC does not prohibit entry into containment at power as long as licensees continue to meet requirements such as 10 CFR Part 20. Containment entries at power are not uncommon in the nuclear power industry.

As' stated above, we do not find that the alleged Davis-Besse's containment entry practices violate federal regulations. Since no violations of our requirements have been identified, no further action is intended at this time. I hope this adequately addresses your concern. During our call on i April 28, 1989, you informed us that you notified Davis-Besse of your contact j with OSHA and NRC regarding this matter. A copy of this letter with your  !
