Dear Congressman Dyson:

I am responding to your letter of May 16, 1989, in which you requested a meeting with the Nuclear Regulator and Baltimore Gas.and Electric Company (BG&E) y regarding Commission your(NRC) concerns associated with continuing safety violations at the CalVeftiCliffs~ Nuclear Power Pla t. The NRC shares your concerns abbut" safety at the Calvert Cliffs facility and has taken a number of actions.to ensure resolution of the problems that have been identified. I understand that these actions were discussed with you during a June 6, 1989 meeting with our Executive Director.

Between May 5 and May 23, 1539, the NRC issued three inspection reports associated with Calvert Cliffs. These reports emphasized

'the' continuing problems at the facility, including the procedural adherence problems that you referred to in your letter. In a letter dated May 23, 1989 (enclosure 1), BG&E committed to keep both Calvert Cliffs units in a shutdown condition until certain hardware issues have been resolved and until BG&E has corrected the root causes of the problems that have been identified in the following areas: (1) the control of system status, (2) the control of work activities, (3) the use of procedures, and (4) the control of procedure changes. The licensee has agreed to meet with NRC management to explain what has been done to correct these problems and to ensure that they will not recur, and to obtain the approval of NRC's Region I Administrator before restarting the first unit. In a Confirmatory Action Letter issued to BG&E on May 25, 1989 (enclosure 2), the NRC accepted these commitments, which will ensure that immediate short-term corrective actions are implemented prior to restart.

The Commission also believes that a longer-term effort is needed L- to fully evaluate and correct all identified weaknesses at the E

facility and that this longer-term effort can best be accomplished through BG&E's further development and implementation of its Performance Improvement Plan. Although we understand your preference for an independent audit of BG&E management, we consider it essential that our licensees remain accountable for 1-F*

The Honorable Roy P. Dyson ti.e safe operation of their facilities, are able to assess their own shortcomings, and develop appropriate corrective actions to resolve identified problems. To ensure that BG&E has adequately assessed the root causes of identified problems and.that appro-priate corrective actions are identified, scheduled, and implemented, the NRC has established a Calvert Cliffs Assessment Panel, composed of senior.NRC managers from our Region I and headquarters offices, to review BG&E's Performance Improvement Plan. Until the Panel has completed its work, the NRC staff prefers to withhold judgment on the need for the independent audit you proposed. We will be pleased to brief you on the results of the review when it.is completed.

I hope that our comments will help resolve the concerns expressed in your May 16, 1989 letter. We will continue to keep you fully informed of activities at Calvert Cliffs.
