This 1s to acknowledge NRC's receipt'of LP&L's check for $50,000.in full

' payment of a civil monetary penalty imposed by NRC order on January 3,1989.

.Your corrective actions will.be subject to review in future inspections.

The NRC staff'has reviewed LP&L's. proposal that the civil penalty money collected:

be donated to Nicholls State University in Thibodaux, Louisiana. A somewhat-similar proposal was rejected by the NRC in response to a petition submitted under 10 CFR 2.206.

NRC lacks legal authority to do anything other than transfer -

to the U.S. Treasury monies collected as civil penalties." Boston Edison Company

!We have also' reviewed LP&L's assertions _ regarding the-NRC staff's application 1

of 10 CFR 50, Appendix.B requirements and we are satisfied that, given the particulars of this case, the staff.has used 10 CFR 50, Appendix B, appropriately and has correctly applied the' agency's Enforcement Policy in this matter. There-

- fore, since LP&L has paid the civil penalty, NRC considers this enforcement action closed and does not-intend to continue discussions of the merits of this case.

However, we do intend to pursue your statement that."...there appear to be

. differences between how LP&L intends to and' operates Waterford 3, and NRC's asserted understanding of how LP&L intends to and operates Waterford 3,.that cannot go. unresolved."' This is a matter of concern to us and needs to be expeditiously resolved. A meeting with you at NRC headquarters will be scheduled j

as soon'as possible. The Office of Nuclear Reactor Regulation will contact you to arrange this meeting.
