.by my February 3, 1989 letter. By letter of June 8, 1989 the Staff expressed

. concern and disagreement about our position.

As a result of the telecon, Duke has agreed to reinstate the commitment to-

. provide physical barriers in Region 2 when unqualified assemblies are stored in'a checkerboard configuration. Studies are being done to determine a suitable design.for these barriers. Until.a suitable design'is available for use, Duke has further committed to move'no fuel into or within a Region 2 rack (Unit 1 or Unit 2) which contains unqualified fuel. There are at present 31 unqualified assemblies checkerboarded in Region 2 of Unit 1, and 3 unqualified assemblies checkerboarded in Region 2 of Unit 2.

An analysis is underway which is intended to qualify these assemblies for unrestricted storage. After these assemblies are qualified by analysis, and/or any remaining unqualified assemblies in Region

2 of each unit are removed from Region 2-and placed in Reaion 1, we may resume placing qualified assemblies in Region 2.
