SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATED TO AMENDMENT NO. 134 TO FACILITY OPERATING LICENSE NO. DPR-59 POWER AUTHORITY OF THE STATE OF NEW YORK JAMES A. FITZPATRICK NUCLEAR POWER PLANT DOCKET NO.59-333 INTRODUCTION By letter dated May 27, 1988, the Power Authority of the State of New York (PASNY or the licensee). requested changes to the Technical Specification (TS) for the FitzPatrick Nuclear Power Plant. The changes are meant to clarify and improve the quality of the TS.

DESCRIPTION Some of the errors which this amendment addresses have been introduced as a result of )revious amendments and some have existed since the initial TS were issued. T1e changes will correct typographical, gramatical, clerical, terminology, or other administrative errors and delete cutdated material.

Specifically, the changes are (listed by TS page number) the following:

(1)* add " Specification 3.0" and its title " General" to the Table of Contents and change the page number for Specification 3.1 to "30f."

The actual TS changes were issed as Amendment No. 83; (vi) add Tables 4.6-2, 3.12-1, 3.13-2, 3.12-3, 4.12-1, 4.12-2 and 4.12-3 and their titles to the List of Tables. The first table was added to the TS as Amendment No. 28 and the rest by Amendment No. 34 but were not added to the List of Tables at that time; (vii) update the List of Figures by adding a symbol to the title for figure 3.1-2 and adding the specification number to the title for Figure 3.5-1, deleting figure 3.5-9 (which was removed from the TS by Amendment No.109), and adding figure 3.5-12 (which was incorporated into the TS by Amendment No. 109); (1) correct the spelling of " explicitly" in the first sentence; (2) add "a" into the first sentence of the definition of Instrument Check to ccrrect the gran:natical error;

-(4)* insert Amendment No. "83" at the bottom of the page to reflect that the page was affected by the amendment, Also, replace " trips" with " trip" in the first sentence of the definition for startup/het standby mode; (5) correct the spelling of the abbreviation for " continued" at the top'a"f the gage and delete o

"a" from the Refueling Outage definition; (6) replace with n in Specification 1.0.X.a before the word " systems," since n means number of systems. Also, place the n in the last line of the specification inside

Specification 3.0.E Bases; (34) rewrite the top paragraph, right column (3.1 Bases), to more clearly describe the nuclear instrumentation coverape for the designated modes of operation; (38) insert "44" into the Amendment Number list to show that the page was changed by this amendment; (41) indicate in Table 3.1-1 with an "X" that the manual scram trip function must be operable in the Run mode. Amendment No. 98 inadvertently deleted this indication when the amendment request was submitted and issued; (41b) add two Less Than Symbols to Table 3.1-1, one before and one after "P," for the turbine control valve fast closure trip setting. They were not included in an earlier revision to tha page; (42)* add a Less Than or Equal To Symbol to Table 3.1-1 for the setpoint of the 10% valve closure trip level setting and add "is less than" to Note 3 ahead of "1005."

These were omitted from an earlier revision; (57) correct five grammatical errors (replace " drop" with " drops" in the second paragraph, remove "this" from the fourth paragraph, replace "of" with "or" in the fourth paragraph, replace " setting" with " settings" in the fifth paragraph, and replace "and" with "or" in the fifth paragraph before the "40"), and delete

" flow" from the sixth paragraph to indicate that the reactor water cleanup trip instrumentation is independent of flow; (58) correct the spelling of

" channel" in the ninth paragraph; (59) insert the present amendment number to the bottom of the page to control a change which was previously issued; (61) insert a "t" after the "2" in the mathematical equation for the optimum interval between tests; (68) irsert "THIS ITEM INTENTIONALLY BLANK" for Item 10 in Table 3.2-2.

This should have been i cluded in the submittal for Amendment No. 84; (70a) replace "psid" with "dp" item 28 of Table 3.2-2 for the Trip Level Setting to more correctly identify

" rods" with " rod" in Specification 3.3.8.1; (101) delete "feedwater from" in the fourth complete sentence of the first paragraph in the right column, since rod worth minimizer automatic cutout is determined by steam ficw only-not feedwater flow; (106) insert "B" for the paragraph nu.nber to identify Specification 3.4.B; (114) add the change bars which should have been indicated f om Ane@ent No. 95; (115a) delete "of 3700 gpm" from 4.5.B.1 which should have been removed in the submittal for Amendment No. 71 since it pertained to l

criteria is given in the referenced TS section; (118) correct the paragraph referenced from 3.5.C to 3.5.C.1 in Specification 3.5.C.1.b; (119) replace

" relief / safety" with " safety / relief" in four places for consistency of I

(144) replace " operable" with " inoperable" in the second sentence under Specification 3.6.G to correct a typographical error and correct the meaning of the specification; (152) delete " coincident high drywell pressure and" from the second sentence of the second paragraph since a plant modification F1-83-034 removed the high drywell pressure permissive for ADS actuation from the A05 logic.

It was reflected in other TS pages in Amendment No. 84 but this page change was inadvertently omitted from the submittal. Also, in the same paragraph, replace " low-low" with " low-low-low" to correct an error which has existed since the initial TS were issued, Also, replace " relief / safety" with

" safety / relief" in five places for terminology consistency; (153) insert "less than or equal to" before 212"F at the top of the page for clarification. Also, correct the spelling of "will" in the fourth paragraph of the Bases for Specification 3.6.F; (171) correct the referenced table from 3.7-1 to 4.7-2 in Specification 4.7.A.2.c.(1); (172) correct the esferenced table from 3.7.2 to 4.7-2 in Specification 4.7.A.2.c.(4); (174) add 10" at the bottom of the page as an Amendment Number since this amendment affected this page. It was inadvertently omitted in the submittal for Amend e t No. 83; (226) correct the spelling of " tests" in the Bases for Specification 4.9.F; (236) correct the spelling of " BASES;" (239)* replace

Also, correct the spelling of

" ventilation" in Specification 4.11.C.1; (240) insert "both ESW systems shall l

be" in the first sentence of Specification 3.11.D.1 for clarity and delete "the" from the first line to correct a grammatical error; (242) replace "3.11.E.1" ylth "4.11.E.1" in Specification 4.11.E.2 to correct the error; (244a) replace "once/ week" with "once/ month" for the test frequency specified in Section 4.12.A.I.b to correct an error introduced when the submittal for Amendment No. 80 was produced. This change was mistakenly incorporated into j

the Amendment but was never analyzed by the licensee or the NRC and restores the frequency to that existing prior to Amendment No. 80; (244f) replace table "3.12.2" with "3.12.3" to correct Specification 3.12.D.1.a and b; (2441) replace table "3.12.2" with "3.12.3" to correct Specification 3.12.D Bases; and (248) replace " Coordinator" with " Superintendent" in the first paragraph of Section 5.4 to be consistent with the organization chart.

EVALUATION The administrative or editorial changes do not change any limiting conditions for operation, surveillance requirement, setpoint or safety limit; nor do they affect the environmental ronitoring program.

These changes clarify and improve the quality of the Technical Specifications by correcting editorial errore i

The majority of the changes are the correction of typographical errors. These I

errors consist primarily of misspelled words but also include inadvertent deletion or misplacement of text.

In some cases, in the process of updating a page for a p'revious amendment, p(which occurred once) a paragraph of one ortions of text were inadvertently deleted.

4 In the case of misplaced text, specification was moved into the adjacent specification. Resolution of these types of errors restore the TS to their proper format. These proposed changes do not effect plant operations since they are non-technical in rature.

Grammatical errors include missing words and improper punctuation. Correction of these errors make the TS easier to read. Other errors are strictly administrative. These include expired pages and specifications. Removal of the expired pages and specifications eliminate the possibility of referring to l

an inapplicable specification.

The change to Table 3.1-2 (page 41) adds a requirement that a manual scram trip function be operable in the run mode. This requirement has existed since the initial issuance of the TS but was inadvertently removed when updating the table for a previous submittal. This proposed change returns the tables to l

its original condition.

l The change to page 144 will correct a condition for plant shutdown resulting i

from jet pump operability. The existing specification states that the reactor l

- l-shall be placed in a t.old condition if a jet pump is operable. This is in l

direct contrast to the preceding sentence which states that, whenever the reactor.is in a mode other than refueling, all jet pumps must be operable, This chance will correct the specification to state that whenever a jet pump is in6perable, the reactor must be placed in a cold condition.

The changes to page 152 are needed to achieve consistency throughout the TS.

The elimination of "...conincident drywell pressure..." from specification 3.6.E BASES is consistent with the changes brought about as a re wlt of a plant modification which eliminated the high drywell pressure permissivo for ADS actuction frca the ADS logic. This change has previously been approved and issued by Amendment 84. The inclusien of this change in the submittal for this amendment was inadvertently omitted.

Replacement of " low-low" in the same specification with " low-low-low" is necessary in order for the specification to agree with Table 3.2-2.

This error has existed since the initial issuance of the TS.

The change to page 244a replaces the "once/ week" surveillance frequency for the high pressure water fire protection system pumps to "once/ month".

This change was erroneously introduced in the process of updating the page for a submittal which was approved and issued as Amendment 80. This submittal did not describe a change to this surveillance frequency and the surveillance

. frequency of once/ month is a condition that has always existed. This change wil return the surveillance interval t6 its orig;nal value.

The proposed charges to the Technical Specifications do not change cny systern or subsystem and will not alter the conclusions of either the FSAR nr SER accident analysis. They are, therefore, acceptable.

ENVIROWNENTAL. CONSIDERATE 0W This amendment involves a change in the administrative procedures or requirements.

In addition, the amendment involves issuance of an amendment to a permit or license for a reactor pursuant to 10 CFR part 50 which changes a requirement with respect to use of a facility component located within the restricted area, as defined in 10 CFR Part 20, and changes a surveillance requirement. The staff has determined that the amendment involves no significant increase in the amounts, and no significant change in the types, of any effluents that may be released offsite, and that there is no significant increase in individual or cumulative occupational radiation exposure.

The Commission has previously issued a proposed finding that this amendment involves no significant hazards consideration and there has been no public comment on such finding. Accordingly, this amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(9) and 51.22(c)(10).

Pursuant to 10 CFR Part 51.22(b) no environmental impact statement or I

environmental assessmer.t need be prepared in connection with the issuance of this amendment.

I i l CONCLUSION We have concluded, based on the considerations discussed above, that:

(1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, and (2) such activities will be conducted in compliance with the Commission's regulations cnd the issuance of this amendment will not he inimical to the common defense and security or to the health and safety of the public.
