REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE By your application dated May 15, 1989 and General Electric Company's affidavit dated May 12, 1989 you submitted a report entitled " Evaluation of the Indication in the River Bend Feedwater Nozzle to Safe'End Weld" and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790.

You stated that the submitted information should be considered exempt.from mandatory public disclosure for the following reasons:

1.

The information discloses n' process, method or a)paratus where prevention of its use by General Electric's competitors wit.1out license from General Electric constitutes n' competitive economic advantage over the companies.

2.

The information consist of supporting data and analyses, including test data, relative to a process, method or apparatus, the application of-which provide a competitive economic advantage, e.g., by optimization or improved marketability.

3.

The information, if used by a competitor, would red'uc'e his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality or licensing of a similar product.

4.

The information reveals cost of price information, production capacities, budget levels or commercial strategies of Ceneral Electric, its customers i

or suppliers.

5..

The information reveals aspects of past, present or future General Electric customer-funded development plans and programs of potential j

commercial value to General Electric.

The information discloses patentable subject matter for which it may be i

desirable to obtain patent protection.

7.

General Electric must treat the information as proprietary according to agreements with other parties.

Therefore, the subject report marked as proprietary, will be withheld from L

public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the-Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of-persons properly and directly concerned.to inspect the documents.

If the need l

-arises, we may send copies of this information to'our consultants working in this area. We will, of course, ensure that_the consultants have signed the appropriate agreements for handling proprietary information.

If the basis _for withholding this information from public inspection should change in the future such that the information'could then be'made available-for public inspection, you should promptly notify the NRC.. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information.
