TDI INSPECTIONS AND INVESTIGAT]Oh5 The purpose of this memo is to follow up my February 28, 1985, mero to you on tRC inspections and investigations of TDI, as they relate to Shoreher. This is in response to Judge Erenner's cuestion on March 6, 1985, asking whether.
- ...any NRC staff office fis) investigating whether TDI has failed to neet requirements for reporting defects in the past ated whether any such non-disclosure problem has continued as recently as the latter part of 1984?"
(Tr. 26409, et seq). Judge Brenner further stated that he hed recalled seserei earlier lists of TDI product improvements, which lists seened to grow in 1erpth.
I do not recall providing such lists to the Board, but the crclesure tc this renc cor,tains seseral letters f rcn TDI which list such p ocuct inpeovenents. As I have stated before, the staff evaluation of the DROR program will teke these irprevements into considerate n.
It is clear, bewever, that the Beerd has a larger concern about the pctsitdlity that future product improvements may not be reported to LILCO or the NRC. The Ecard also seers to be concerned about the need for an ireestigation of pessible wrcngdoing by TDI.
I would life to address these two concerns seperately.

March ??,1985 Pt ' eel that as e result of the inspections done by 1T0 in the fall of 1983 erd TD]'s interaction with.the Owner's Group end the NRC's 101 Project Group, TDI has become nuch nore sensitive to reporting problems and product improvements. The staff will continue to ronitor TDI's perfomente in this area.
In the area of investigations of wrongdoing,1 must admit that 1 ar.'
et a loss for a response. My job, and that of NRR and IE, has been to detemine whether.TDI engines are satisfactory from the standpoint of safety.- I feel that-1 have done so, and I am confident that a mechanism exists, through the DROR procram and the ongoing LILCO maintenance and surveillance prcgren, to prevent serious technical problems f rom developing which could comprecise the safe operetion of Shoreher.
Issues of potential wrongdoing by individuals or by the TD1 organization should not impact plant safety, given the safeguards I have discussed above.
Investigations of these issues are donc by the NRC Office of Investigations (01), which reports directly to the Comission.
I have discussed several issues with 01 which ney warrant their attention but I have no further infomatien' about the status cf their investigation.- 1 intend to femelly refer,several iters, the technical aspects of which are already known to thy'b6)rd and parties, to 01, via the'EDO, within the next few weeks.
I do notjfell/ that the completion of any potential investigations by 01 into these nytturs is recessary to conclude that the TDI engines at Sherehen are adequate to perfom their intended function.
} would also like to reiterate that if the Board has any additieral questions about these metters, I would be pleased to answer ther verbally.
