SUBJECT: NOTICE OF VIOLATION

-(NRC INSPECTION REPORT NOS. 50-327/89-07 AND 50-328/89-07)

Thi s refers to the Nuclear Regulatory Commission - (NRC) routine monthly

inspection 1 conducted by K. Jenison from February 5- - March 4,1989. ' At the

,

conclusion of the. inspection, the findings were discussed with those members of

your staff _ identified in the enclosed inspection. report.

The areas examined during 'the inspections included operational -safety-

. verification, maintenance and surveillance activities and L observations :of

refueling activities.

Within the'se areas, the inspection ~ ~ consisted of

-

selective examinations of procedures and representative- records, interviews

with personnel, and observation of activities in progress.

The inspection findings indicate 'that certain activities appeared to violate

NRC requirements. 'The identified violation : involved several examples of

failure to establish and implement procedural requirements

involved a fuel handling event -in which' an interlock designed to.. prevent a

safety event was bypassed: _and could not perform _ its~ intended function.

to include in your response to examples a. and e. a discussion of why your

previous corrective actions were not effective.

The violation, references to pertinent requirements, and elements to be

included in your response, are described in the enclosed Notice of Violation.

Section 2.c of the enclosed inspection report discusses an administrative

program weakness associated with implementation of a recent upgrade to the

radiological control program. This issue was of concern to the NRC since NRC

resident inspector access to all radiological controlled areas was restricted

for a brief period of time due to the program change. The same type of access

problem was also encountered during the as-built inspection in 1987 after the

implementation of a radiological control prog' ram change.

Please provide a

written . response within 30 days of the date of this letter describing why the

10_ CFR' 50.70 requirement for resident inspector access is not being incor-

porated .into radiological control program changes and how you intend to ensure

that it will be in the future.
