.NRC Inspection Report Nos-50-413,.414/89-10 Reply to Notice of Violation Gentlemen:

Enclosed is the response for-the Notice of Violation ~ issued May 4, 1989'by

'D. M. Collins. The violation was for failure to describe two abnormal releases in the March,'1988 Semiannual Effluent Release Report'.'

Although.

descriptions'of the releases were not contained in the report, both abnormal.

. releases were fully. described in Licensee Event Reports (LERs) 413/88-10 and:

413/88-12.

.-10 CFR 2, Appendix C, Section'V.A states "In addition,<for'isolatAd Severity-Level V violations, a notice of. violation normally will not be issued regardless of who identifies the violation provided that the licensee has initiated appropriate corrective action before the inspection ends."

Since the Semiannual Radioactive Effluent Release Report was updated during the-

opportunity to exercise the discretion allowed in Part 2.

4 DUKE POWER COMPANY REPLY TO A NCTf1CE OF VIOLATION.

413, 414/89-10-01 VIOLATION:

Technical Specification 6.9.1.7 requires that the Radioactive Effluent Release Reports shall include a list and description of unplanned releases from the-site to unrestricted areas of radioactive materials in gaseous and liquid effluents made during the reporting period.

Contrary to the above, the 1988 Semiannual Effluent Release Report listed two abnormal releases but did not include descriptions of the events.

This is a Severity Level V Violation.

RESPONSE

1.

Admission or Denial of Deviation:

Duke Power Company admits the violation.

2.

Reason for Deviation if Admitted:

This violation is attributed to an inappropriate action. Duke Power Personnel assumed that providing the number of releases and Curies involved met the Technical Specification 6.9.1.7 requirement.

3.

Corrective Actions Taken and Results Achieved:

l A revision to the Semiannual Radioactive Effluent Release Report was i

submitted to the NRC Document Control Desk on April 5; 1989 upon discovery of this deviation and prior to the conclusion of the inspection. This revision provided a description of the abnormal releases listed in the report. Appropriate personnel have been instructed to include descriptions of abnormal releases in all future Semiannual Radioactive Effluent Release Reports. A review of all previous Semiannual Radioactive Release Reports revealed no other deviation involving a failure to provide a description of a listed abnormal release. Therefore, this deviation was l

determined to,be an isolated occurrence.

Corrective Actions to Be Taken To Avoid Further Deviations:

Corrective actions already taken and described in paragraph (3) above will avoid future recurrences.

Date of Full Compliance:

Duke Power is in full compliance.
