{{#Wiki_filter:l l o APR 041989 l Docket No. 50-440 i Docket No. 50-441 The Cleveland Electric Illuminating Company l ATTN: Mr. Alvin Kaplan Vice President Nuclear Group 10 Center Road Perry, OH 44081 Gentlemen: l We have received your letter dated March 13, 1989, which transmitted Temporary Change Number (TCN) I to Revision 9 of the Perry Nuclear Power Plant's Emergency Plan. We have completed our review of TCN-1 and have ostermined , that it is consistent with the requirements of 10 CFR 50.54(q) and does not i decrease the effectiveness of the Emergency Plan. -l TCN-1 consisted of several revised Emergency Action Levels (EALs) associated with abnormal inplant radiation levels or with a fire in a nuclear process system. .The improved wording of these EALs should make your staff's decision ) on whether to declare an emergency more straightforward for such situations. Be advised that 10 CFR 50.54(q) requires prior NRC approval of any changes to your plan which may decrease the' effectiveness of the plan. However, if your safety review assures no decrease in emergency preparedness effectiveness, i then changes to the plan may be made and implemented without prior NRC approval in accordance with 10 CFR 50.54(q). Also, any changes to the Emergency Plan Implementing Procedures should be made in accordance with the requirements of 10 CFR 50, Appendix E, Section V. In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of this letter will be placed in the NRC Public Document Room. If you have any questions, please contact Mr. T.
