, 1 NOTICE OF VIOLATION University.of Washington Docket No. 50-139 Research Reactor License No. R-73 During an NRC inspection conducted on July 27-28, 1987, violations of NRC requirements were identified. In accordance with the

  • General Statement of Policy.and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1987), the violations- are listed below:

~ A .' '10 CFR Part 50.54(q) states in part: "...A licensee authorized to Epossess and/or' operate a research reactor or a fuel facility shall follow and maintain.in.effect emergency plans which meet the requirements in Appendix E of this part."

Chapter 10, " Maintenance of Emergency Preparedness" of the licensee's

' emergency plan states: "The University Police training in basic radiation protection will be through a course administered by Radiation Safety. The University Police will become familiar with the facility by either an onsite tour or a VCR presentation."

Contrary to the above, no familiarization training or onsite tours had been provided to a minimum of eleven patrolmen who have joined the University Security force during the period of July 1, 1986 and July 28, 1987.

This is a Severity Level IV Violation (Supplement VIII).

B. Technical Specifications (TS),Section VIII.K.(1)(a), require immediate notifications and a followup written report of abnormal occurrences as defined in Section J of the TS.Section VIII.J(3)(d), defines as a minimum that an abnormal occurrence include: "A safety system component malfunction or other system or component malfunction which renders or threatens to render the safety. system incapable of performing its intended safety function."

Contrary to the above,. Regulating Rod and Shim Rod #3 (i.e. , control blades) drop times were measured to be in excess of the one second time limit prescribed in the TS, Table II, during 1986 and 1987 and were not reported to the NRC.

This is a Severity Level IV Violation (Supplement I).

i Pursuant to the provisions of 10 CFR 2.201, Uni'ersity of Washington is hereby required to submit a written statement or explanation to the U. S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555 with a copy to the Regional Administrator, Region V, within 30 days of the date of the letter transmitting this Notice. This reply should be clearly marked as a

" Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation if admitted, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken. Consideration may be given to extending the response time for good cause shown.
