SUBJECT:

NECESSITY OF AN ENVIRONMENTAL APPRAISAL IN ISSUING HEU-LEU CONVERSION ORDER In response to your memorandum of August 6,1987 on the same subject, we agree that an environmental assessment need not be prepared for an enforcement order issued under 10 CFR 2.204. The HEU-LEU conversion orders are, however, somewhat different from most orders issued by the Commission.

The HEU-LEU conversion rule (10 CFR 50.64) provides that after the staff review of a licensee's safety analysis of all changes in the license, facility, or procedures necessary to effect conversion, the Director, NRR, will issue an enforcement order directing both the conversion and the necessary changes. As explained in the statement of considerations for the final rule, this approach was chosen so that in the event a hearing is requested, the licensee need not participate in the hearing, thereby avoiding litigative expenses associated with the conversion and hearing. Since staff procedures for issuance of

, license amendments usually require preparation of an environmental assessment, the staff decided that it would be prudent, although not legally necessary, to prepare an environmental assessment in connection with the RPI order, especially since it was the first such conversion order.

Upon further consideration, and since the finding of no significant impacts in the RPI assessment would likely apply to any of the conversions, the staff intends not to prepare environmental assessments of future conversion orders.
