NOTICE OF VIOLATION Commonwealth Edison Company Licenses No. NPF-37; NPF-66 As a result of the inspection conducted on July 27-31, 1987, and in accordance with 10 CFR Part 2, Appendix C - General Statement of Policy and Procedure for NRC Enforcement Actions (1987), the following violation was identified:
10 CFR 50.54(q) requires that a licensee authorized to possess and/or operate a nuclear power reactor shall follow and maintain in effect emergency plans which meet the standards in 50.47(b) and the requirements in Appendix E.
Contrary to the above, on October 20, 1986 and March 21, 1987, the licensee failed to, timely and adequately, classify and declare an emergency condition per the EALs.
This is a failure to adequately follow and implement the Generating Station Emergency Plan.
This is a Severity Level IV violation (Supplement VIII).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation:
(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.
Consideration may be given to extending your response time for good cause shown.
