Dear Administrative Judges:

As you know, officers and employees of my client, O.B.

Cannon & Son, Inc., expended a considerable amount of time and expense in connection with hearings in the captioned proceeding in the fall and winter of 1984 when several of them appeared as witnesses.

As a result of recent discussions with representatives j

of Texas Utilities Generating company (TUGCO) has agreed to reim-burse Cannon $105,000 by August 24 for litigation costs which were incurred as a result of Cannon's participation in the hearings.

However, since the Cannon witnesses, except for Mr. Trallo, were called as Board witnesses, it is our agreement with TUGCO that

l payment will be made upon disclosure of this matter to the Board, unless the Board voices some objection.

This letter constitutes

that disclosure.

Cannon and TUGCO wish also to advise the Board that TUGCO intends to retain Cannon to perform certain coating appli-cations at Comanche Peak.

The activities contemplated would 1

involve the application of a specific coating to the service water system.

Cannon was recommended to Stone & Webster Engineering Corporation by the coatings manufacturer based upon Cannon's past experience in applying this particular coating.

1 v issues before this Board nor to Cannon's activities which were the subject of ASLB hearings in late 1984.

Since neither TUGCO nor cannon perceives any reason for precluding cannon from performing these services, TUGCO intends to retain Cannon to do so.
