PROPOSED IMPOSITION OF CIVIL FENALTY - $205,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Two Hundred Five Thousand Dollars ($205,000) will be issued on or about August 24, 1987 to GPU Nuclear Corporation for its Oyster Creek facility. This action is based on three violations associated with the suppression chamber-torus vacuum breakers, reactor building-torus vacuum breakers, and procedures for making temporary variation:: to the facility.' The suppression chember-torus vacuum breaker issue is viewed to be the most signi-ficant violation inLthat these vacuum breakers were blocked open with the reactor at 23% power, which significantly degraded the pressure suppression capability of the suppression chamber in the event of a less-of-coolant accident.
The reactor building-torus vacuum breaker issue was considered nut as significant because although these vacuum breakers were also blocked open, the isolation valves in-series with the vacuum breakers remained capable of automatic closure on a containment isolation signal. The procedural violation is related to the licensee's failure to properly perform safety reviews for temporary variations to the facility. Two yiolations were assessed the base civil penalties (Severity Level II and III) and the civil
,penalty for one violation was escalated 50% because the violation existed since 1977 during deinerting evolutions.
It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Deputy Executive Director for Regional Operations to sign this action. The schedule of issuance and notification is:
Mailing of Notice August 24, 1987 Telephone Notification of Licensee August 24, 1987 A news release has been prepared and will be issued after the licensee receives the Notice.
The State of New Jersey will be notified.
The licensee has thirty days from the date of the Notice in which to respond. Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
