APPENDIX A NOTICE OF VIOLATION University of California at Berkeley Docket No. 50-224 TRIGA, Mark III Reactor License No. R-101 During an NRC inspection conducted on July 13-16, 1987, violations of NRC requirements were identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1987), the violations are listed below:
A. Technical Specifications, Section 6.2(c) states in part: "The RHC or a Subcommittee thereof shall audit reactor operations at least quarterly but at intervals not to exceed four months. "
Contrary to the above, RHC audits of reactor operations were not performed for the first and second quarters of 1986 covering a span of more than ten months.
This is a Severity Level IV Violation (Supplement 1).
B. Technical Specifications, Section 6.7(c)(4), requires a written report be submitted to the NRC within 30 days of any observed inadequacies in the implementation of administrative or procedural controls.
Contrary to the above, a 30-day report for failure of the RHC to conduct the first and second quarter audits of 1986, spanning a period of more than ten months, had not been initiated as of July 13, 1987.
This is a Severity Level IV Violation (Supplement 1).
Pursuant to the provisions of 10 CFR 2.201, University of California at Berkeley is hereby required to submit a written statement or explanation to the U. S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D. C. 20555 with a copy to the Regional Administrator, Region V, within 30 days of the date of the letter transmitting this Notice. This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation if admitted, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or t
