SUMMARY

DISPOSITION OF CONTENTIONS 4 AND 9 (TOW TRUCKS AND FUEL TRUCKS)  ! Pursuant to 10 CFR S 2.749, LILCO hereby moves for summary disposition of Contentions EP 4 and EP 9, which address " legal authority" for using tow trucks to re-move road obstructions and for providing gas to motorists, respectively.

                             ~In a real emergency LERO would get permission from Suffolk County (or, as a back-up, from New York State) before removing any obstructions from the roads or giv-ing any gasoline to evacuees. In a fast-breaking accident LERO would get permission from the County Executive by telephone, as detailed in the accompanying LILCO's Mo-tion for Summary Disposition of Contentions 5 and 6 (Making Decisions and Telling the Public). In a more likely, slower-developing accident, permission would be obtained face-to-face from a County representative at the LERO EOC.

LERO tow trucks and gasoline pump trucks would be mobilized and sent to their

                     " deployment locations" precisely as called for in the LILCO plan. But they would not
                    . actually remove any obstructions or provide any fuel until the.LERO Evacuation Sup-port Communicator had told them to by radio from the EOC. All road crews, including the 12 who remove obstructions and the seven who provide gas, have two men and are equipped with two-wty radios (Fact IN providing instant communication with the 1/      Numbered " Facts" refer to the Statement of Material Facts that is Attachment I to this motion.

l EOC. Hence permission to do their jobs would be obtained and transmitted to the road j k crews very quickly. There would not likely be any lessening in dose savings because of , I the need to have " legal authority." And there can be no doubt that the authorities can ask utility employees for help of this sort, because, as the attached Affidavits of Charles A. Daverio and Jay Richard Kessler show, they do so all the time. I. What the Plan Says The LERO arrangements for removing obstructions and providing gas are found for the most part in OPIP 3.6.3 (Attachment 2 to this motion). The LILCO plan pro-vides for an " Evacuation Coordinator," one of the five senior LERO coordinators who report directly to the Manager of Local Response, who in turn reports to the Director of Local Response. See LILCO Plan at 2.1-2. The Evacuation Coordinator has three specialized function coordinators reporting to him; one of these three is the Traffic Control Coordinator. LILCO Plan at 2.1-4. The Traffic Control Coordinator is respon- ' sible for, among other things, coordinating the road logistics aspects for an evacuation of the general public and overseeing the evacuation routes and traffic flow considera-tions. Ld. All of these people are assigned to the LILCO EOC and remain there during the emergency. Reporting to the Traffic Control Coordinator is the Road Logistics Coordinator, also at the EOC, who is responsible for coordinating field activities of road crews. OPIP 3.6.3 S 2.5. He implements road crew operations as directed by the Traffic Con-trol Coordinator. OPIP 3.6.3 5 5.5.1. His duties are covered by 5 5.5 of OPIP 3.6.3. He can communicate with road crews by giving messages to the Evacuation Support Com-municators. There is one Communicator for each staging area and another for the road crew trucks.

l The LILCO plan provides 12 two-man road crews to clear obstacles and seven two-man crews to use gasoline tank trucks to provide fuel. The job of the road crews is I described in S 5.9 of OPIP 3.6.3, and the " road crew procedure"'Is Attachment 2 to l OPIP 3.6.3 (see Attachment 2 to this motion). Road crews are provided with mobile ra-dios for communications with the EOC directly. LILCO Plan at 3.4-3 They are di-rected to tune to channel 3 on their two-way radios and to stay tuned to this channel for the entire emergency. OPIP 3.6.3 S 5.9.6; OPIP 3.6.3 Att. 213, p.1 of 2 (p.19 of 77). Preassigned deployment locations for the road crews are listed in OPIP 3.6.3 Att.

               ~8. Storage locations and assignments of road crew vehicles, including both gasoline tank trucks and tow trucks, are listed in OPIP 3.6.3 Att.12.

II. What the Board Has Already Found The adequacy of LILCO's plans for removing road obstructions and providing fuel have already been litigated. With respect to cars running out of gas, the Board has found that "there are common sense remedies": IX.A.20. Vehicles Out of Fuel . Suffolk County alleges that roads will also be blocked be-cause cars will run out of gas during the evacuation. Their estimate suggests that some 277 vehicles will be affected. Polk, ff. Tr. 2909, at 12-16. LILCO calculates that about ninety-six cars will run out of fuel. Corc'aro et al., ff. Tr. > 2337 (Supp.), at 29-31. There is no need for us to resolve a purely academic dispute as to how this estimate was arrived at or how it might be in error, because there are common sense remedies for cars out of gas. By the County's own as-sertion some people will buy fuel before they evacuate. LILCO will post fuel trucks at seven locations to service cars out of fuel. Id. at 31. Tow trucks will be on the road to clear blockages. Urbanik, ff. Tr. 3430, at 13. Stalled cars can be pushed off the road. Cordaro et al., ff. Tr. 2337, at 86-87. Driver:: can coast off the road when they run out of gas. The , Board therefore regards the dispute over these estimates as l speculative and not in need of resolution. It is sufficient that the number of vehicles involved in actual road blockage would be modest relative to the total evacuating traffic and that reasonable means of mitigation exist. ] 1 l

on the basis of two considerations: first, the number of ob- j?ifM. structions-likely to need clearing, and second, the time j$ $ needed to clear a given obstruction. Cordaro et al., ff. Tr.  : y 6685, at 7. Based on national accident statistics, LILCO esti- i K mated that four accidents / breakdowns would occur during an ( g evacuation of the Shoreham EPZ. Ld. at 8. Not all of the ac- E J cidents/ breakdowns would result in a disabled vehicle and the  !!: need for road crew response. Id. at 7-9. Response to acci- 1  : dents / breakdowns will be rapid because road crews will be as- *g ' 'y signed to intersections of major east-west and north-south routes. Ld. at 9. LILCO owns additional alternate trucks. Tr. 6862 (Weismantle).  ; $ l Ld. at 809-10. IX.B.6. Concl6sion We find that LILCO's plans for twelve road crews to clear disabled vehicles from the roadway are reasonable. We ac-cept LILCO's testimony that the number of accidents or ;_ ,j breakdowns during an evacuation is likely to be modest and i* C s. p k Q

that not every mishap will require assistance because many accidents or breakdowns will not result in a vehicle inevitably lef t on the road or in a totally disabled vehicle. The County, however, is correct that evacuation scenarios wherein more than twelve trucks are required can be postulated. It is suffi-cient for us to know that future decisionmakers will have the resources and capability to respond flexibly to contingencies as they arise. In this case LILCO has many additional vehicles it could use to clear roads if need be and there is no reason-able basis for thinking that road clearing during an emergency would be hampered by lack of resources with which to re-spond. We therefore dismiss Contention 66.A. Id. at 811. These arrangements would be equally adequate when subordinated to the di-rection of County (or State) authorities, as discussed briefly below. III. How LILCO Would Get Permission in a real emergency LERO road crews would be mobilized and dispatched pre-cisely as called for in the LILCO plan, since they need no special permission to drive on public roads. But they would not do their emergency jobs until told to by the EOC, 1 f which would first have received permission from Suffolk County. l-As explained in the accompanying LILCO's Motion for Summary Disposition of Contentions 5 and 6,in an emergency the LERO Director of Local Response would ordi-l narily receive permission to perform needed functions from the County Executive. It is ind'sputable that the County authorities may lawfully ask LILCO employees to perform services like towing vehicles (Facts 2, 3); as the attached Affidavit of Charles A. Daverio on LILCO Responses to Requests by Local Law Enforcement Officials for Pub-lic Safety Assistance shows, this sort of help is requested and given routinely, Thus, when the LERO Director, at the EOC, got permission f rom the County (or State) to remove obstructions and give gas to motorists (Facts 4,5), he would relay the information to the Road Logistics Coordinator, also in the EOC. (This would be done el-ther in one of the briefings that the Director holds for his staff, or by using the public address system in the EOC, or by walking over to the Evacuation Coordinator or Road Logistics Coordinator and telling them.)

1 The Road Logistics Coordinator, through the Evacuation Support Communicator, thereupon would notify the road crews that they were free to act according to the plan. In the early stages of an emergency the Communicator would transmit this Information by dedicated phone line to the staging areas, where the assembling road crews would be told; if legal authority were received from the County later in an emergency, af ter the - rood crews had deployed, the Communicator would radio the trucks directly (Fact 1). The road crews have to be told at the time of the emergency where to go even in a LILCO-only response; the only difference with governmental participation is that the EOC will have to have received permission from the authorities first. There is,in short, no litigable issue in Contentions 4 and 9. When informed that I l an obstruction needed to be cleared, the Suffolk County Executive, using his,"best ef-forts" to protect people, would certainly allow LERO to clear it. If there were an evac-uation, he would certainly allow LERO to provide gas rather than let evacuees' cars run dry. It is, therefore, abundantly clear that the absence of " legal authority" would not 1 harm the public health and safety or lead to lesser " dose savings" than otherwise. 1. All LERO road crews, including those who are to provide gasoline to motor-ists in an evacuation, have two-way radio communication with the LERO EOC.
2. The Suffolk County authorities may lawfully ask (or direct) utility company employees to remove disabled vehicles from the road in an emergency.
3. The Suffolk County authorities may lawfully ask (or direct) utility company employees to provide fuel to motorists in an emergency, -
4. In an emergency requiring the evacuation of the public from around the Shoreham plant, if an obstruction occurred on the roads that would hinder evacuating motorists, Suffolk County would permit LERO personnel to remove the obstruction un-less there were a better way to remove it.
5. In an emergency requiring the evacuation of the public from around Shoreham, Suffolk County would permit LERO to give fuel to members of the public who needed it to evacuate.

Attachment 2 i OFIF 3.6.3 Page 1 of 77 OPIP 3.6.3 TRAFFIC CONTROL 1.0 PURPOSE This procedure describes the traffic control operations of the Local Emergency Response Organization (LERO) during a radic-logical emergency at the Shoreham Nuclear Power Station (StPS). These operations are performed to optimize traf fic flow out of the EPZ during an evacuation. 2.0 RESPONSIBILITY 2.1 The Evacuation Coordinator is responsible for coordination of evacuation-related activities, including traffic control. 2.2 The Traffic Engineer is responsible for assessing the effect of road impediments on evacuation flow and recommending rerouting of traf fic to an alternate route as necessa ry. 2.3 The Traffic Control Coordinator at the EOC is responsible i f or directing the implementation of this procedure. I 2.4 The Traffic Control Point Coordinator at the EOC is responsible for coordinating field activities of Traffic Guides. 2.5 The Road Logistics Coordinator at the EOC is responsible l for coordinating field activities of Road Crews. 2.6 The Evacuation Rcute Coordinator is responsible for coor- [ dinating activities of the Evacuation Route Spotters. The Staging Area Coordinators are responsible for I 2.7 overseeing the activities of field and staging area personnel, and for briefing field personnel on radiation protection measures prior to deployment. 2.8 The Lead Traffic Guides will be a liaison between the l Traffic Control Foint Coordinator and the Traf fic Guides providing direction and coordination. Return to original deployment locations after each impediment is removed.

3. Drive vehicle _to sign storage location, obtain signs and sign supports required from 3ign/ Equipment List and. load onto road crew vehicle. Report'back to Lead Traffic Guide.
4. Upon instruction from Lead Traffic Guide, proceed to intersection of North Country Road and Snore Road (Traffic ,

Control Point 81) following route specified on Area Map.

5. Start at Traffic Control Point 81andmoveeastwardalongkorth Country Road. Assist Traffic Guides in setting up_ signs at specified locations along North Country Road and Lower Rocky Point Road as indicated on the Route Diagram. At intermediate locations without Traffic Guides, set up signs as indicated.

Instruct Traffic Guides to prevent venicles from traveling eastbound on North Country Road and on Lower Rocky Point Road and to encourage motorists to use botn westbound lanes. Rev. 5

After setting up signs here, proceed to assigned Road Crew Deployment Location as previously specified by Lead Traffic Guide. Move all road impediments that adversely affect traffic.
7. Implement Steps 6 through 12 of Road Crew Procedure.
8. When informed by the Road Logistics Coordinator that emergency operations have ended , return to the One-Way Flow Section and remove signs before proceeding to the Emergency Worker Decontamination Facility in Brentwood. -
