Dear Mr. MacFaciand:
On July 10,1998, the NRC completed an inspection at your Clinton facility. The enclosed report
presents the results of that inspection.
Instances of improved perfumance were noted during the inspection period in the operations
area. Most notably, operators responded well to two events involving the loss of electrical power
,

to safety related buses. Additionally, conservative decisions were made to resolve issues
affecting the calibration of main control room indications and the identification of improperly
installed fasteners on the Division ill Emergency Diesel Generator.
We are concemed, however, about six violations of NRC requirements that were identified. The
first two violations concemed the failure to take adequate corrective actions for a long-standing,
nonconforming condition involving excessive service water flow to the residual heat removal heat
exchanger bypass line, and to ensure an adequate testing program for 480 Vac molded case
circuit breakers existed after deficiencies were identified in the 4160 Vac circuit breaker testing
program. The other four violations concerned issues surrounding the adequacy of and/or
adherence to procedures for: (1) main control panel walkdowns by operators; (2) high pressure
'
core spray discharge valve testing; (3) maintenance troubleshooting in response to main steam
t
isolation valve failures during testing and a ground on main control panel P-680; and (4) the
retum to service of the meteorological tower and a process radiation monitor prior to completing
required surveillance. These violations are of concem because they represent continued
problems with the corrective action program and procedural adequacy and adherence.
However, I have been authorized, after consultation with the Director, Office of Enforcement, and

the Acting Regional Administrator, to exercise enforcement discretion for the violations in
accordance with Section Vll.B.2, " Violations identified During Extended Shutdowns or Work
l
Stoppages," of the General Statement of Policy and Procedures for NRC Enforcement Actions"
(Enforcement Policy), and not issue a Notice of Violation in this case. The decision to apply
enforcement discretion was based on consideration of the following: (1) significant NRC

enforcement action was taken against the Illinois Power Company for corrective action program
and procedure adequacy and adherence problems; (2) additional enforcement action was not
considered to be necessary to achieve remedial action for the violations due to Clinton Power
Station's commitments in its Plan For Excellence to take actions to address the corrective action
program and procedural adequacy and adherence issues prior to plant restart; (3) the violations
were related to problems which were present prior to the events leading to the shutdown; (4) the
violations were not classified at a severity level higher than Severity Level ll; (5) the violations
were not willful; and (6) lilinois Power Company will meet with the NRC to explain their efforts to
resolve corrective action problems prior to restart as reflected in the NRC's September 26,1997,
Demand for Information (EA 97-435). Effective corrective actions will need to be demonstrated
prior to restart. The NRC must emphasize that failure to achieve effective performance
improvement would lead to more significant regulatory sanctions.
In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter and its
enclosure will be placed in the NRC Public Document Room.
