NRC OFFICE OF INVESTIGATIONS REPORT NO. 3-1998-016
Dear Mr. Wadley:
This ietter refers to investigations conducted by the Northem States Power Company (NSP) and the NRC Office of Investigations (01) into the circumstances surrounding an individual's failure to provide complete and accurate information to NSP about his full criminal history. The individual apparently failed to disclose his total criminal past to NSP at the time he prepared a security questionnaire to obtain unescorted access to NSP's Monticello Station. The individual admitted to the NSP investigators that he omitted this information from his questionnaire because it was a period of his life that he wished to forget. Both investigations determined that on July 21 and July 29,1997, the individual revealed his prior arrests and convictions for several misdemeanor offenses, but deliberately failed to disclose information about a previous arrest and conviction for " felony theft." A copy of the Ol report synopsis is enclosed.
The NRC-approved Monticello Station Security Plan requires NSP to review an individual's criminal history as a part of the assessment of a person's reliability and suitability for unescorted access to the station The NRC recognizes that NSP promptly identified and corrected this issue before a violation of the security plan could develop. Therefore, the NRC has clostd this issue without any enforcement action.
Regarding the individual, the NRC concluded from the information obtained during the investigations that the individual deliberately failed to make a full and complete disclosure of his crirninal history when he preoared the required security questionnaire. By doing so, he placed himself in violation of 10 CFR 50.5, " Deliberate Misconduct." Specifically,10 CFR 50.5(a)(2)
I prohibits any employee of a licensee or any employee of a licensee's contractor from
' deliberately submitting to a licensee any information that the person knows to be incomplete or inaccurate in some respect material to the NRC. An individual's criminal history is material because it is r aquired to be considered by an NRC licensee to determine the trustworthiness and reliability vf an individual prior to granting a person unescorted access to an NRC-licensed i
l nuclear power plant. This information is also material to the NRC because it is used by the NRC to evaluate a licensee's compliance with 10 CFR 73.56, " Personnel Access Authorization Requirements for Nuclear Power Plants."

While the individual was in deliberate violation of regulatory requirements, the NRC recognizes:
that NSP took significant disciplinary action against the individual; that the issue represented an isolated, non-repetitive act of a low-level employee without supervisory or managerial involvement; and that the individual, a temporary clerical worker, did not possess a skill unique to the nuclear industry so that he would i;hely apply for unescorted access at another nuclear power plant. Therefore, the NRC is not taking any enforcement action against this individual.

SYNOPSIS This investigation was initiated on April 6, 1998, by the U.S. Nuclear Regulatory Commission (NRC), Office of Investigations, Region III, to determine if a contract worker had deliberately falsified his unescorted access authorization information on a Northern States Power (NSP) Nuclear Security Questionnaire, dated July 21, 1997, and subsequent revision dated July 29, 1997, in that, he failed to self disclose a felony theft convict. ion that occurred in July 1981.
Based upon a review of evidence contained in the documentation provided by NSP and the NRC technical staff, it is concluded that the contract worker, deliberately falsified, through an omission of material facts, his unescorteri access authorization information on the NSP Nuclear Security Questionnaire, dated July 21, 1997, and subsequent revision dated July 29, 1997, by failing to self disclose a felony theft conviction that occurred in July 1981.
