CIVIL PENALTY IMPOSED BY ORDER ON OCTOBER 13, 1987 I (EA 86-148)

This refers to your letters of November 12 and 13, 1987 dealing with civil penalties issued by the NRC. The first letter dealt with our Order Imposing Civil Monetary Penalty, dated October 13, 1987 (EA 86-148), and stated that a check (#401380) in the amount of $50,000 was enclosed in full payment of the civil penalty. This letter was received at the same time as the second letter, explaining that that check was inadvertently enclosed with another letter dated November 16, 1987.

This is to advise you that although the letters were received, the check for

$50,000 did not accompany the correspondence. A thorough search has been made of the NRC offices that handled the letter, and the check has not been found. This natter has been discussed with you and with Mr. Chuck Krause of your staff. Mr. Krause agreed on December 14, 1987 that paynent on the previous check for $50,000 could be stopped and a new one issued if these discussions cculd be documented in a letter from the NRC.

This is to confirm that despite our efforts to locate the check, it has not been found and we request that you take what actions are necessary to issue a new check in paynent of the civil penalty.
