VERMONT YANF.EE NUCLEAR POWER STATION - APPARENT FAILURE TO MEET 10 CFR 50.30(b) REQUIREMENTS (TAC NO. MA1721)

Dear Mr. Maret:

By letter dated July 10,1998, Mr. Gautam Sen provided information to support your May 8,1998, proposal to amend the Vermont Yankee Nuclear Power Station license concerning the suppression pool nter temperature limit.

Title 10 of the Code of Federal Regulations (10 CFR), Section 50.30(b) requires that each application for a license and each amendment of each application must be executed in a signed original by the applicant or duly authorized officer thereof under oath or affirmation. This requirement applies to supplementalinformation provided to the NRC relating to license amendment requests since the supplementalinformation has the same legal standing as the originallicense amendment reo.uest. Therefore, additionalinformation provided must be submitted under oath and affirmation per ib CFR 50.30(b).

Contrary to 10 CFR 50.30(b), the July 10,1998, letter providing additional information pertaining to your May 8,1998, license amendment request was not submitted under oath and affirmation and does not meet the requirements of 10 CFR 50.30(b).
