MODIFICATION OF SWRI CONTRACT FOR OPERATION OF THE CNWRA FOR TECHN! CAL SUPPORT TO NRC STAFF IN THE REVIEW OF A TOPICAL SAFETY ANALYSIS REPORT SUBMITTED BY PRIVATE FUEL STORAGE, LIMITED LIABILITY COMPANY FOR THE PRIVATE FUEL STORAGE FACILITY Please take the necessary contractual action to modify NRC's contract with Southwest Research Institute (SwRI) for operation of the Center for Nuclear Waste Regulatory Analyses (CNWRA or Center) to include technical support to NRC staff in the review of a Topical Safety Analysis Report submitted by Private Fuel Storage (PFS), Limited Liability Company, as part of its application for a license to construct and operate the Private Fuel Storage Facility, a proposed away-from-reactor independent spent fuel storage installation. These activities include the preparation of an Safety Evaluation Report. The program element plan (PEP) is attached (Attachment 1).

An analysis of the relationship between the potential scope of work to be performed and NRC's responsibilities under the Nuclear Waste Policy Act, as amended (NWPA), was performed to determine if the proposed work is within the Center's mission, under its charter. The determination was made that the proposed work does relate to NRC's high-level waste (HLW) responsibilities under NWPA and is within the Center's mission, as defined by its charter. Results of the analysis are provided in Attachment 2. The analysis has been reviewed by the Office of the General Counsel (OGC). As indicated in Attachment )

I 3 OGC has no legal objection to the staff's determination that the proposed Center work would support NRC's HLW program and is within the Center's charter.

2 l The Center should be directed to use the attached PEP as the basis for development of an Operations Plan for fiscal year (FY) 1998. Milestones and deliverables for the FY 1998 l Operations Plan should be developed using this information, indicating whether the deliverable is an intermediate or major milestone. The NRC staff will provide the CNWRA with comments on the interim reports as outlined in Section 9.O. All PFS deliverables are predecisional, and should be marked accordingly. The Center should be encouraged to work with their NRC counterparts to ensure a thorough understanding of NRC requirements.

The Center should be directed to submit the Operations Plan three weeks after receipt of this guidance package.
